Spouse open work permit - Query

Hi,
I am the primary applicant and its been 13 months since I filed the sponsorship application from India. I have received AOR1 so far and still my sponsor's eligibility check is going on.
Therefore, no Medical request as well.
I am in Canada on Tourist visa. Can I apply for SOWP from Canada considering my sponsorship application is filed from outside Canada?
I spoke an immigration consultant and was advised that I can apply and I will get it in 3 months.
Considering my application is still in the initial phase, I am seriously thinking about it. But it will be great if I can get some advice.
Kindly suggest.

The answer is no.

Since you applied outland, you do not qualify for an open work permit unfortunately.

The immigration consultant who told you that you qualify is an idiot and doesn't understand immigration rules (or just wants your money). Do not get any further advice from this person or give them any money.

Even if you are in Canada on a TRV, you still don't qualify. You only qualify if you were sponsored inland.

Just to follow up on my post above... Have you applied for your GCMS notes? It's strange that your sponsor hasn't been approved yet and that might indicate there is a problem.

I applied for GCMS and still awaiting the response. Meanwhile, I got in touch with the Member of Parliament and he spoke to ircc agent. I also called the helpline and one of the agent was generous enough to share the status. All of them stated the same thing and confirmed no communication is missed and they don't need any further docs as of now.
  • Received the application on Nov 2, 2020
  • The criminality verifications: Passed
  • The initial assessment to ensure the sponsor meets all the sponsorship requirements: in progress
  • Other steps (the security verifications, medical examination requests etc): in progress too.
They just don't answer why is it taking time and when the process with move forward.

Thank you for the advice. Really appreciate it.
