Spouse open work permit DENIED... with following reason.

I am Indian citizen and living in India only. I am an Architect (B.Arch) and working as a Jr. Architect in private firm in India.
I recently got married and my husband is in Canada on "Open Work Permit" after post graduation from Canada.

I have applied for "Open Work Permit for Spouse" on 17.01.2017.
Filled IMM1295E, IMM5257B_1, IMM5707E and letter of Explanation from my husband along with his Work permit letter, Job offer letter and Salary Slips.
And our marriage certificate and 1 photograph of marriage.

My application got rejected and when my husband seek information under "Access to Information Act" we have got with following explanation for rejection.

"Online case reviewed. Spouse stated to be in Canada on PGWP valid until 2019/10/19. Applicant and inviter are stated to have been married on May 09, 2016. One photograph has been provided that shows them exchanging Garlands. No photographs have been provided that would depict traditional ceremonies taking place. I am not satisfied the evidence provided is sufficient to establish that a legally valid marriage took place between them. Mere possession of a marriage certificate does not establish the validity of a marriage. Not satisfied that applicant has demonstrated that she is the married spouse of an inviter. Consequently, I am not satisfied she is eligible for an open work permit under R205(c)(ii). Refused.

Please review my case and advise what to do now? Can I apply again with some more photographs? What more evidence required to prove validity of marriage?

And If I just want to visit Canada now then can I apply for "Visitor Visa" along with continuing process for Work permit? or that would make work permit process unnecessarily complicated?

PLEASE GUIDE... THANKS IN ADVANCE....!

I think u should reapply the same, this time use marriage photographs in which u did traditional marriage and also show them whats app, facebook chat, any tickets together (show all the things which make your relation strong). Dont forget to include a valid Marriage Certificate

Thanks

Hi Mahinav,

If in passport spouse name (lady) is showing with her husband's name with same address than you don't need to provide any further docs like fb chat/whatsapp chat. Extra doc should be valid/original marriage certificate, invitation letter from the one who is sponsoring to their spouse.. That should be good. If you have enough saving & person having good job in Canada than they'll give you spouse visa for sure ( I'm saying you from my personal experience)..

Hello Dhara,

I have been gathering some info for SOWP. My wife has received open work permit yesterday. For case history, we applied in october, had to further medical on march 3/4 and finally received visa on march 7. Her passport was stamped yesterday and I found out that the visa was valid till March 31 2018 (via CIC account, I am still waiting for passport). I am confused by it as my study permit is valid till november end. Does the date on CIC account mean she has to enter canada march 31? Will she receive SOWP extension after entering canada? Please help me with your experience in this regard.

Looking forward to hear from you.

Greetings everyone.
I am currently on my PhD (commenced Sept. 2018) in Canada. I applied for SOWP on behalf of my husband on January 24, 2019 but today I got a rejection. Here is the reason:

you did not provide a valid Labour Market Impact Assessment from the Department of Economic and Social Development Canada and/or demonstrated that you are entitled to apply for an open work permit.

Please what does this mean? Note that LMIA is not required for our application. I feel really bad; we included every [possible document. Please kindly advise. Thank you

Hi, I am a PR who had applied under the Skilled Worker category and my wife submitted an OWP application stating that I as her husband have a PR status and am currently employed in a full time job.

Are there any possible reasons for rejection of this SOWP application, as I am both a PR and a skilled worker with a job in Canada, please suggest

They would probably expect you to apply for spousal sponsorship rather than a work permit. I would expect a refusal.

hi @Buletruck , thanks for the response, my wife already has an approved multi-entry TRV for 10 years, besides her OWP application is currently mapped with her UCI and valid biometrics, her medicals are valid till early May 2020, will these points help in any positive progress of her OWP application, kindly suggest
