Spouse Open Work Permit - ( but I don't have job offer in hand but has Valid WP)

Hi Friends,
I need one information. Me and my wife both Indian citizens. I recently got graduated from Master program from Canada, Montreal.

My case is :
1. I applied for Work permit after graduation and it got approved for 3 years.
2. I am still searching for Job, taking interviews, yet to get any offers
3. I am getting married in couple of weeks
4. I am intereted in applying for PR. I got my CSQ through PEQ. After marriage I will apply for Permanent Resident application.
5. My wife is working in US and she has H1B. We will be in India for our marriage.

What I am looking for and need help:
1. Can I apply for Open Work Permit for my wife outside Canada since I have valid Canada Work Permit, however I do not have any job offer letter at this
point of time (it might take some time as well).
2. I see in some blogs that if applied for OWP at the port of entry, we have to show proof of employement of mine.
3. Is there a way to apply for my wife for Open Work Permit, me without having job offer in Canada.

Please help me.

I did work for Software company in Montreal while doing Masters. I worked for around 6 months. I worked till December but not now.
Can I use that offer letter? and apply SOWP for my wife? I did pay my tax for the salary I received from the Software company.

No, you cannot use an old offer letter. That would be lying to CIC in order for your wife to gain status in Canada, which is fraud.

in my minimal experience it is better to get a job under O,A,B category In NOC list , its little easy to get open work permit

Hello.
my husband and I want to apply for PEQ graduation around 1 month later(after that my husband receives his B2 certificate). He is living in Montreal now and has a Post-graduation work permit,he has not a job yet. I'm not in Canada .After receiving CSQ what kind of visa I should apply for entry to Canada(for example Visitor visa,Open work permit,...)?

hi my name is bobby. my wife is in canada on PG work permit and it will expire on november 2016. i applied twise open work prmit and got rejected when my wife was on study permit. my wife is now working there and not the work not come under O,A,B category. can i reapply again with the current situation or i need to wait undil she get a job under o,a,b category?please help

She must have a NOC A, B or 0 job for you to qualify for an OWP.

hi... Thanks for the information. Along with Valid Post Grudation Work Permit, I also have valid Student Visa till August. Does that make any difference in my case?

Hi,
I am on open work permit which is expiring in March 2016 under my wife as she is the student in Canada. But, She will be graduating soon and will be getting PGWP.
Can I apply again for open work permit as I have a job under NOC B category. But, She doesn't have a job offer under NOC O, A, B.
I already got PGWP and expired.
Please seniors respond.

Do you mean March 2017?

As the PGWP holder, your wife is the one who is required to hold a skilled job in order for you to qualify for an OWP. The fact that you have a skilled job doesn't matter. Note that just a job offer is not enough; your wife must have payslips showing that she has actually started working in a skilled job in order for you to apply for an OWP.

If she hasn't started such a job before applying for her PGWP, you will need to apply to change your status to visitor. You will need to stop working as soon as your current work permit expires.

I will be extending my work permit for few more months as my wife study visa expires in March 2017. But, her classes will end in May.
So,do you think I can extend my work permit after she gets new study permit atleast till June 2017?
By then, if she gets job with NOC O, A or B with atleast 3 pay slips will that work?
Is there any other go for me other than visitor visa?

You could try to extend your OWP along with her study permit but given the short duration that her new permit would be for, there is no guarantee that your OWP extension would be approved.

Another small and quick question: Can I apply study permit instead of visitor visa or it has to be only visitor?
Is there any barrier like I have to apply study permit from outside Canada? When I am on spousal open work permit?
I guess NO but just want to make sure.

If you have admission to an educational institute and the required proof of funds, you can apply to change your status to student.

However, this is not a way to continue working. You still have to stop working as soon as your current OWP expires and will not be able to work again until you commence full-time studies.
