Spouse Open Work Permit at POE

Hi All,

Could you pls help to advise my case:

My wife got study permit and studying ESL at Canada currently, My children and I already got visitor visa, we had visited one time in last Feb'16. I would like to apply open WP at POE in next time visit in Aug'16 based on my wife study permit, is it possible? or I have to apply Open WP at my home country or apply Open WP inside Canada, as I know it is take long time process visa for both case..

Looks like you can apply at POE if you're from a visa exempt country or you already have a valid visa:

Check thee online/paper application and prepare all documents and have filled all the forms out.

Get a copy of your spouse Permit, marriage certificate, other documents to prove relationship for more than one year, child birth certificates and a letter signed by your spouse explaining you'll ask for SOWP (english certificate translations if needed)

If you're form a non-exempt country, you need Visa (multiple re-entry better)

If you're coming with you children's perhaps you need something else, I don't know.

For children's school, get record of inmunization before leave.

However, I don't have experience on this case, so better wait for some more opinion about it.

My wife got SOWP at POE firts time we came, but we have all the paperwork prepared by my company lawyers (visa exempt country).

Thank you for your reply, I have a little bit afraid because I saw not many people apply SOWP at POE (non exempt visa) they almost apply inside Canada if they already had TRV (visitor visa) but it take a lot of time ( 2 - 4 months) if you apply inside Canada.

If you already have Visitor visa and SOWP is not granted, probably you can back as visitor, but it depends on inmigration officer.

I guess you're good to try. Be candid and polite explaining why you need SOWP soon instead applying within Canada (if asking for), such having a job offer of needing to work.

A fiend of mine got SOWP at POE coming with his child after his wife settled here, he's from a visa exempt country.

Be sure you have a multiple-entry visa and still being valid for all the time your wife Permit, otherwise your SOWP will be issued until the visa (or passport, same thing) expiration date

I hope someone share his experince about it.

I think so

But entry to Canada is always up to Inmigration Officer.

If Officer is not convinced you're willing to leave Canada when visitor visa ends, entry can be denied.

Most probably you'll be OK, but it's nothing 100% sure.

I understood what you mean, I will prepare my current employment contract, my current employment confirmation, pay slip, bank statement, bank confirmation, my annual leave approval and the other document to proof that I will leave the country when my visitor visa end in case they reject my SOWP.
