Spouse Open Work Permit Application refused basedon 205(c)(ii)

Hi,

I have a closed work permit with NOC code 2171. My wife applied for spousal open work permit and got refused with the below reason:

1. You have not adequately demonstrated that you meet the requirements of a work permit pursuant to section 205(C)(ii) of the regulations

This is the only reason they have mentioned in the letter.

We had a very strong documentation. Don't know where was the mistake. can some one please help me to get over this situation?

Since you've only asserted that you had very strong documentation but not described any of it, I have absolutely no idea.

Sponsor documents (My documents):
Work permit, pay stubs, bank statement, passport copy, Notice of assessment (tax submitted last year), employment verification letter including my job duties, my Canadian Temporary visa, my passport

My wife documents:
Applications for temporary visa, family information, her passport, her job experience letter, her bank statement (5.5 lakhs)

Common relationship documents:

Marriage certificate, wedding invitation cards, whatsapp chat history, marriage, engagement and trip pictures, FB SS's

General eligibility requirements for a work permit say that an applicant must:

  • prove to an officer that you will leave Canada when your work permit expires
  • show that you have enough money to take care of yourself and your family members during your stay in Canada and to return home
  • obey the law and have no record of criminal activity (we may ask you to give us a police clearance certificate),
  • not be a danger to Canada’s security
  • be in good health and have a medical exam, if needed
  • not plan to work for an employer listed with the status “ineligible” on the list of employers who failed to comply with the conditions
  • not plan to work for an employer who, on a regular basis, offers striptease, erotic dance, escort services or erotic massages, and
  • give the officer any other documents they ask for to prove you can enter the country

Yeah I checked the eligibility requirements and I guess we have followed the everything.

I talked to my consultant and he said that the only possibility might be about the timing. Like we applied in year end and they must have already approved the letters for which they might be targeting for this year.
So he suggested to apply again with the same set of documents in Jan 2020 where they will consider the application for the new set of jobs requirement quota.

Moreover they didn't mention any reason other than 205.c.ii

Which means we have satisfied officer on all above mentioned points.
Thoughts?
