Spouse Not Accompanying in PR application - While both are in Canada for 2 Years - URGENT

Hi All

I have a situation and looking for urgent urgent:

My spouse and I are in a closed and Open work permit in Canada and have been working for the last 2 years. I recently applied for an Express entry profile, with my spouse as non-accompanying. ( Though mentioned in the family details). ( Also, have a baby born in Canada)

Also, my wife's company is initiating a closed work permit(c20) for her from the current open work permit. She wants to continue on Closed work permit rather than a PR.

Without adding spouse to the application, my CRS is 486; if i add her, it will be 470.

Question: Will it be a problem later by IRCC, if i receive an ITA? Will there be any additional questions on not adding a spouse?

I plan to provide a justification that she wants to continue on her closed work permit, and later decide upon if she wants to stay in canada for long.


Please help with if any similar scenarios in past/experiences.

You should add her as non-accompanying and after you get the PR you can only sponsor her so she could get her PR.
I heard that IRCC takes it as misrepresentation, since we both are in Canada and working. I hope it doesn't causes any problem in spousal sponsorship. Any insights?

Misrepresentation is when you don't mention your souse at all. Just don't try to fool IRCC in order to get a higher score, you might regret it eventually.

Yes. That's what we are doing now.
I heard some stories on IRCC asking for explanation on single profile, even though spouse is in Canada. Better to add .
