my wife (who is also being sponsored by me) is applying for a TRV, and i'm wondering what happens if they reject her application. will she have to inform the VO where her spousal sponsorship app is being processed?

the reason i'm asking is because i recall one of the forms for the spousal application asking whether the applicant had ever been rejected a visa. if CIC actually rejects her TRV app, then wouldn't that form need to be updated and resent to the VO processing her spousal application? i don't want to take any chances with this.

Nothing will happen.

are you sure that we don't have to inform the VO processing the spousal application and send them an updated form if necessary?

The VO will be aware of the application through GCMS.

You only need to send a new form if requested to do so.

On the form they ask if you been denied visa before, if you are denied trv while pr application is process, they will know, no need to fill forms for that ;)

Agreed with everyone above ^^

As you are aware, I had applied for TRV for my hubby in March and was declined (as expected). My sponsorship file will automatically have the notes of rejection along with the reasons (basically the rejection letter which was sent to me). I had also linked my TRV app to my Sponsorship app. This way, I'm not hiding or doing anything mischievous. CIC can't scrutinize you for trying to reunite with your spouse by applying for TRV. The application might get rejected based on the fact that the applicant might overstay their welcome, which is reasonable.

Not to scare you or anything, but, I also know about an applicant on the forum from ~ 6 months ago, who had applied for TRV and was banned for 2 years from reapplying due to some misrepresentation.

All the best!

lol flx2015, are you still on the fence about applying for a TRV? :P :P :P :P

The answer is no, it will have zero effect, as you've already submitted the PR application. And no you don't have to update them about the refusal. In other words, there's zero risk to you for applying, aside from the $180 fee (visitor visa + biometric) you'll have to pay.

yes because now i'm afraid of them falsely accusing my wife of misrepresentation. maybe i'm paranoid because i have a very low opinion of CIC, but just look at this: http://www.canadavisa.com/canada-immigration-discussion-board/misrepresentation-t403428.0.html

i feel like they'd be totally fine with handing out 5 year bans to applicants for simple typos or for things that aren't the applicant's fault.

That's such a rare case, as they would normally call the manager rather than some random employee.

Dont worry about that. However u have to make sure u do the best job u can when applying for trv. Dont be vague and go to the visitor visa forum for tips

You're too paranoid flx!

perhaps, but i still think that some of CIC's visa officers are incompetent and cold blooded. i remember reading about another case where they gave a skilled worker applicant a 5 year ban because they were convinced he lied about his employment status. he later found out that they verified his employment details using "open source information", which actually turned out to be LinkedIn. apparently the applicant's manager messed up her dates of employment on her LinkedIn profile and that was all the proof they needed.

Again this is all extremely rare, and even if they accidentally label her case as misrepresentation, that can easily be appealed if it's such a blatant error on their part.

Does she even have a job? You mentioned she has almost zero ties back home, so if she has no job, then there's nothing to worry about at all. Even if she does, the chances of that happening are so rare.

yeah she doesn't have a job, but my worry was that something similar might happen in other areas of the application. i just don't want someone who's incompetent to review her application.

anyway thanks everyone for the replies. i need to sit down and think about this for a while...

The applicant has to list all refused TRVs, and other refused visas, on the application when the refusal happened before the PR application was submitted. Since you have already submitted the PR application, any refusals after that date do not have to be listed on the forms, and they will not expect you to resubmit the forms with the new information. However, the visa officer might ask about this later, either by asking your wife to resubmit the forms, or by asking about it at an interview.
