my friend has an undocumented status in the US for more than 10 years now. He got married to his girlfriend who is Canadian Permanent resident on August 2016. His wife filed for spousal sponsorship last November 2017. While in process he was requested an FBI clearance, which he did accomplished. Until now, the application has not been decided. Just want to know some idea as to what other things will be requested and how much more time will it take before the application will reach a decision. Or what happens next after providing the FBI clearance.​

If it has taken two years, there is something very strange going on with the application. Has your friend's wife called the IRCC?

No, she has not called, as they rely on the immigration lawyer that is handling the case. Does his illegal status in the US makes the application complex and causes delay. Hope to hear from those who have undergone the same

Yes, his illegal status in the US makes the app more complex. Where is he from? Did he try to claim asylum in the US? What is their relationship history? How much time have they actually spent together? Is the spouse living in Canada?

He is from the Philippines. He entered the US w/ B2 Visitor Visa. They have known each other for several years before they got married, since then the wife comes to the US almost every month to spend time together. They have been married for 3 years. Yup the wife lives in Canada. What could possibly happen to the spousal sponsorship. What’s next after IRCC request for FBI clearance which he has provided. Will medical examination follow or maybe anything else to complete the process?

She should be very careful about how much time she spends out of Canada. PR sponsors are required to live in Canada throughout the visit. Too much time out of Canada is a risk.

The medical will eventually be requested and he should expect an interview request. As he is in the US illegally, he would be required to return to the Philippines for any interview.

Might as well serve as a warning to the wife. Anyhow I just need to wait & see. Hopefully everything goes well with the application process and in the end will bring favorable decision.
