Hello,

I have been reading various articles including threads here on the most appropriate type of application to be made spouse. It is a bit overwhelming to read so much info. My case is as below:

I have a fiance. If i prefer doing an outland application (go home and get married first), how soon can she travel to Canada once we file the OL application? What sort of visa will she need/get then to travel at the earliest? I understand we can't file for an open work permit in Outland but after marriage if she comes to Canada when and how can she start working?

Alternatively, if she is able to enter Canada on a visitor visa by herself and we plan to get married here, then can she carrying on staying with me? (do we need to apply for an extension? and can we encounter any problems along the way on it?) or will she need to go back home and wait till her application gets processed? I understand here we can apply OWP so while that gets applied for too and say her TRV is about to expire soon than does it get extended or stands cancelled too?

Im sure you might have answered these somewhere in earlier threads but i just wanted to ask again specifically to my case as was a bit confused reading bits and pieces.

Hello Ro.

Since how many Years are you and ur fiance together. Sponsorship dont mean you need to get married because their is a limit of years u need to be married. Its will look like a fake.

Hello,

We were dating for 2 years before we got engaged in Dec 2017. i got my COPR in Aug 2017 but then had no plans of instant marriage but closing to date of leaving we decided to solidify the relationship with at least an engagement and then decide the route forward.

I am a PR residing in Vancity, BC. We plan to get married for sure all as per the law only. Just not sure where and how to better and quicken her chances of being with me.

Ok next point where is she living at the moment. If u do inland u need to as always for the visitor status same like u did.

It depends if she can get a visitor visa to come to Canada.
If she can proof strong tied to her current country of resident, and has good travel history, she may be able to get a TRV.

Then she can join you in Canada and get married here. She will need to apply for extension for her visitor status before that expires if she hasn't received her OWP (or some said having the application for OWP will give her implied visitor status) or PR status by then.

Getting married and filing OL (not sure what is OL applicant) will not give her any special visa to travel to Canada.
She will need to wait for the PR applicant to complete and approved before she can come to Canada.

Would be up to doing things asap as and if she gets her TRV. This question on the back of not knowing for how long will she be granted a TRV (a month/max 2 may be). Anything i could/should get done at the back end once she gets her TRV and before she actually travels to save time?

So outland could take upto 6-8 months. right? so she can't travel till then? not even on a TRV? :(

I thought both inland and outland is target to complete in 12 months (for most cases).

She can get TRV and apply for outland. They are independent.
i.e. if she gets TRV, you can still choose to fly there and get married in her homeland, then apply for outland.

Outland applicant doesn't give you any special right to get TRV.

A few things to consider:

1. You (the sponsor) are a PR so no matter what you choose regarding Inland (if she can get a TRV) or Outland, you yourself will need to remain inside Canada for the entire process. If your spouse is unable to get a TRV you'll need to be prepared to spend up to 12 months living separately.

2. CIC takes the context of culture seriously. In India, big traditional cultural weddings are very normal and you would be inviting extra scrutiny if you eloped. (I'm not saying it's impossible, but you'll be creating a red flag for yourselves).

3. If she gets married before applying for TRV, her TRV will likely be denied because she would have a much stronger connection to Canada (you as her husband) than her home country. But without the traditional wedding you risk that red flag mentioned in the previous point. If she is denied a TRV she won't be able to travel to Canada before the application is approved.

4. CIC has a target of processing 80% of applications within 12 months. Some happen faster, some slower. If your application gets pulled out of queue due to needing an interview or having additional documents/proofs requested during processing, that removes your application from the 12 month target and no one knows how each individual application can be predicted on a timeline. The 6-8 months you might have seen are some of the more recent outland applications from the United States. In this forum, you'll see separate threads for each month for Outland applications. The applicants in each month maintain a spreadsheet where each self reports the progress of their applications. It would give you an estimate for India applications, for example, how they are moving along but keeping in mind that every application is unique and it's sometimes not a good idea to compare too closely.
