That's correct. You only qualify for an open work permit if you apply inland (once the first stage of processing has been successfully completed - currently 9/10 months). There is no OWP when you apply outland. Instead (as rjessome explained), you qualify to work in Canada once you have been approved as a PR and have landed.

Thank you scylla. That is helpful .. albeit not very encouraging. I keep on hearing that an outland spousal application is so much quicker and I heard from another immigration specialist while in Canada that assured me that it would definitely not take as long as 18 months for an outland spousal application no matter where I was from .. but that's what the cic website says for my nearest visa office in Pretoria. Are the processing times as shown by the website realistic?

If so we might consider doing the application inland .. does this stop me from being hired as a foreign worker via the normal process (positive LMO etc) after making the application, and if so would there be a way to work it subsequently to get implied status as a worker eg by withdrawing the application and reapplying?

If you go to trackitt.com you may be able to find spousal cases in Pretoria and see their actual timelines.

If you do inland, you must stay in Canada for the duration of the processing.

Whether you are inland or outland in Canada on a visit visa, if you find an employer who will apply for your LMO, you can apply for a work permit.

The link you showed me makes me feel a lot better about my OL application thanks (there was even one out of 7 that took only 88 days!).. I'll check out the same for other offices for more examples. What I noticed is many of the quicker applications had their medical examinations done before and sent with the initial application. I've done the exam before but over a year ago so I assume I should do it again anyway ... does it have to be in one of the South African approved sites or can I do it in Canada? Also .. do I need to be requested to do a medical first or can I just go ahead and do it?

You assume that she will get a tourist visa to come to Canada for 6 months? This is by no means guaranteed. If she does get into Canada, she can apply to extend stating that she is waiting for PR. That will likely be approved as long as she can show funds to support herself or you show funds to support her.

Her immigration application she has in process now will not fail if she gets married unless she is being sponsored as a dependent child of her parents. In that case, she is no longer a dependent child if she gets married. In all other cases, her immigration application continues to get processed. She should still inform immigration she got married though.

If she gets a tourist visa to go to Canada, there is no problem having the medicals in Canada. When she gets her PR visa, she either has to leave and re-enter Canada to land as a PR or she can see about making an appointment to land at a CIC office in your town.

If she is so pregnant she is not allowed to fly, she could hardly be denied to extend the visit visa. The implication is that as a visitor, she is not covered by health care so any expenses with the pregnancy and even the birth if it happens before she gets PR and health coverage would have to be paid out of pocket. This could amount to thousands of $.

A visitor visa should only be given to people who are visiting and not to people who are planning to stay in Canada for good. This is a major problem for spouses of Canadians and PR's who need a visa to visit Canada because they are often denied. If she is denied, then you must sponsor outland and wait for your spouse to get PR before she can come to Canada. If you are a citizen, you may stay with her in her country while you wait. If you are a PR, you must be in Canada to sponsor so you will be separated.

My wife's medical will be expired on June 8th and she was asked to send passport for the visa on May 23 . The passport will not be back on time (by Pony Express) for her to enter Canada . is there anyone who knows about the time it takes to have a new medical done and how long it takes to re issue the visa.
She is going through the Moscow visa office.

Advise the Visa Office that she is doing a new medical and send the receipt by courier to them ASAP. It should take about 4 weeks after that but that's approximate.

The financial requirements to sponsor are to not be in receipt of social assistance except for reason of disability, not to be an undischarged bankrupt and not to be in default of any previous sponsorships. There is no housing requirement, nor is there a minimum income requirement to sponsor a spouse.

I need serious help...I am born Canadian but have lived in the US for 15yrs, since I was 18yrs old. I am currently living in Chicago. My fiance lives in Bosnia. How should I even go about this? Should I go there and marry him and then apply? Should he come on a visitors visa and then marry him in Canada and then apply? If I marry him in Bosnia can I apply for him while residing in the US? I have every intention of moving back to Canada and staying there. My mother lives there and will go live with her until I get my stuff together. How long is the wait time for all this and what are the fees? People are telling me crazy amounts like 7000.00+ is that true? Do I need a lawyer? HELP, anyone he applied for visitors visa to the US and today got denied, grounds being he can't prove he would go back, uh, suicidal...this man is my soulmate.
