1. Does she need to be physically present in Canada for this application? And will she being in Canada make the application any faster? Is it required to approach a lawyer in Canada before filing the application or not?

2. She is a student and stays with her parents in Canada.Can she still sponsor me? If this is not possible, will a declaration from her parents will help us for the spousal visa application?

3. Does she have to go through an interview process or have to show any type of clearance ( police, income tax etc) during the application cycle or is it for the applicant (which is me)?

4.Can I travel on a visit visa between the spouse visa application process? Will traveling on a Visit visa in between a spousal visa application affect the application process?

1. No, she doesn't need to be in Canada. However, she will need to submit proof that she will be returning to live in Canada when the application is processed. The app could take longer if IRCC has to request more proof of intent to return; otherwise, there is no difference in processing time. You don't need a lawyer.

2. That's fine. Get a notarized letter from her parents stating that they will support you guys.

3. She doesn't have to have an interview or provide PCCs. See the checklist for the required documents.

4. You can apply for a TRV but with a Canadian spouse and a PR app in process, there is little chance of approval. It will have no effect on the PR app.

Hi, I am a permanent resident working in Canada and planning to get married to my fiance in India later this year. I had stumbled upon this thread and had few queries of my own, hopefully some of you'all can clarify my doubts/questions.

• My fiance is a working professional in India and we do not want to stay separate after our marriage in different countries ( Canada/India), would it help if after marriage she applies for a visitor visa, comes with me to Canada, we apply spousal sponsorship from here along with an Open work permit application so that after grant of Open work permit she would start looking out for jobs in Canada till the time the spousal application gets processed.
• or, I get married to her in India, come back here all by myself and apply for the sponsorship where in the sponsored person (my wife) will be out of Canada till the time the application gets processed. In the meanwhile she could come visit me here on a temporary resident permit (visitor visa) or I could go visit her.

In both of the above scenario, we both feel the first one will be feasible as it reduces our time of separation however, I believe it is not as simple as it sounds, I need your expertise and advice how to go about it, which route to follow and what are the general processing times in each of the above scenarios.

Your options really depend on whether the TRV is approved. With a PR spouse, chances of approval are very low, as she would be considered a high risk for overstaying.

Hi all,
I applied for my student visa in March and July 2016 but was refused and deemed inadmissible for 5 years due to misrepresentation. However, my girlfriend is there in BC doing her MBA and we want to get married this year end or next year starting but me not in Canada is creating problems between us.
Is there anyway I can still end up with her in canada and we start living together? Any idea or guidance will be really helpful in us being together?

You can apply to return to Canada when the 5 years are up or your future wife can sponsor you if she is a PR or citizen by then.

List all trip you, and if applicable, your family members have taken outside your country of origin or residence in the last years(or since your 18th birthday if this was lees then 10 year ago.)

a) You- Means Principals applicant travel history.

b) Your spouse or common law partner

My question is in (B) I have to give them travel history of my sponsor also?

please help and advise.
