Hi to everyone specially to Leon. I want to ask if it is possible to have a decision made status in a month, a friend passed their application in december and their status is now on DM. they have a misrepresentation issue due to undeclared child (they chose to be honest since they do not know about the misrepresentation law when the husband applied for PR ) and planning for appeal in humanitarian and compassionate grounds because they are sure the cic will know about the misrep.. but since the status now is in DM they think that they're in luck and cic missed the misrep part.. but still hoping for a PPR soon (ofcourse).. what do you think? positive on PPR or soon rejected? do they reject application after DM status? thanks.

The Decision Made from Mississauga is about eligibility to sponsor. It has nothing to do with the misrepresentation or H&C at this point. That will be discovered and assessed at the visa post processing the file.

Dear Leon and others
Thank you for your time in advance. Your advice would be greatly appreciated with my current situation.
Fiancee/Wife (On 4th Feb 11 :D): Canadian Citizen living in Calgary, Alberta. Occ: Firefighter (10yrs)
Myself / Husband: Australian Citizen living in Sydney Australia. Occ Police Officer.(17yrs)

Our initial intention was to be married this coming 4th Feb in the USA and for my wife to sponsor me for PR in Canada. We were intending to apply "Outland" as this would generally be the quicker option (Step 1- 43 days & Step 2: 8mths) Since I cannot work in Canada during this process, I am able to take up to 12mths long service leave from work at half pay and could stay with her on a visitors visa (6+mths) for the last few months of the process.

However the Universe playing its cards to the both of us, to our happy surprise we are now expecting our first child in early September of this year. She intends to give birth in Canada. So hence our new challenge that has been given to us.
Obviously I would like to be with her during the whole time, however immigration is a long and confusing process. We would like to get our application right the first time and PR approved asap.
My wife is still at work on restricted duties and will be, right up to as close to the end as possible. Then she will have to apply for Empolyment Insurance (As Canada does not have paid maternity leave like in Australia) However she would like me to be living with her during the important phase from June onwards.

Seeing that I have up to 12mths paid work leave I intend to take during that period, how would you suggest to go about it. "Outland" is quicker though I cannot work, which I am relying on paid leave and savings while I wait for approval or "Inland" The process is far longer ( Step 1: 9mths, Step 2: 9-18mths)
however I can only apply for an open work permit in Step 2. In which the majority of my paid leave will be used up in Step 1.
With limited work options being available to me in Step 2. (I cannot apply to the Calgary Police until I have my PR approved) I would have to find some other form of work in the mean time.
So the whole process has become even more stressful and time is of the essence.

Your advice would be greatly appreciated and welcomed.

So is your intention still to get married February 4th? Do you plan to take your 12 months leave from your job at that time? You could postpone it until a little later and then come to Canada (as a visitor) and be with her at the time she gives birth. You could also enter as a visitor after you get married and apply to extend your visa when it is about to expire at the 6 month point. However, you will not have applied for sponsorship at that time so you need to be very clear with CBSA at the time you enter that you and your wife fully intend to submit the application right away. Perhaps pay the application fees and show them the receipt.

Outland is still the better option. The whole process will probably be over (PR granted) for an outland process by the time you would receive first stage approval for the inland process. Yes, you can apply for a work permit with an inland application but you only get the work permit IF you are approved at the first stage which takes about 9 months for assessment. So in either case, you are not able to work for a long period of time. In an outland application, your PR would probably already be decided by then or very shortly thereafter.

Yes, that sounds like a good plan. By the time you re-enter in June/July, you will have received your file number from Sydney. Bring that with you. Just some advice, you should get your medical and police clearances done now, if you have time before the wedding. That will enable you and your wife to complete the application very quickly after you get married and submit it right away. No point in delaying, especially with a baby on the way.

By the way, congrats on the marriage and baby. Best of luck.

Hi Leon and others, my wife is Canadian and we have just moved to Canada a couple of months ago with our children. I am British as are our children but with her Canadian nationality we know they are automically Canadian too so have applied for their Citizenship Certificates. For me we have applied for the Spousal visa in Canada. Currently we live with my mother-in-law while we save up to get our own place which naturally will go alot quicker once I am working!

Naturally we want our own place as quickly as possible and someone suggested we look at Social Housing. My question is will applying for Social Housing (in my wifes name naturally) affect my visa application given that she is the sponsor? I know I am not allowed any recourse to public funds and I wonder therefore if her applying for social housing would be seen as using public funds something that I believe she is not allowed to do either while sponsoring me? My other question regards working. When is it normal for them to give you permission to work? Is it 9 months after applying once the first stage approval has been given or do they give it sooner?

Thanks for any help you can give!

Hi Everyone!

Question directed to Leon or anyone else that may have an answer. We sent in our docs in Nov and recieved a letter last week from the Colombo office asking for my husband's originial police cert from aussi as he lived there for close to 2 years.

We have already submitted this and spoke with a friend who was in a similar situation and was told that they asked her the same thing (original aussi cert) and that she submitted a notarized copy with a cover letter stating that the original was already submitted.

They are refusing to process any further without the document and we're handing it in over the next 2 days. I guess my biggest concern is how much longer has this delayed the process? as per my countdown i have at least another 5-6 months during which time i am gonna have to stick it out. but its sooo soo hard! and i was hoping that maybe, just maybe, they will take less time to process our file..

also is getting the CAIPS a bad idea? this is the second birthday that i have to spend without my husband or my family and away from my friends. at this point i just want to pack up and go be with him.. maybe if i win the lottery? :)

You mean you are in Canada on visitor status? You should apply to extend your visitor status a month before it expires.

She is not supposed to be taking any social assistance. I do not know if this type of social housing you are looking at is considered social assistance. You can call the CIC call centre and ask their opinion or talk to an immigration lawyer. You don't want to take that risk unless it is absolutely certain that it will not kill your application.

If you applied inland, it will take 8 to 9 months to give you first stage approval if everything goes well and then you will get a work permit if you applied for one with your application package. If you didn't, then you can apply for it at your first stage approval and it will take another couple of months.

If you applied outland through the UK, you will probably have your PR itself before 9 months are up and will not need a work permit.

Thanks for the info, doesn't sound good :-( Will try giving CIC a call tomorrow to see if they can confirm. Having already sent in my application is it possible to leave the country and change it into an outland application or is it too late for that now and if I wanted to do that to get things done quicker would I need to pay all the fees again along with cancelling my inland application? I know cancelling my inland application won't give me my fees back though which really sucks considering they wouldn't have even looked at it yet!

I think they give the fees back if you cancel before they start processing? You can not change inland to outland. You can only cancel inland and apply again outland. You do not have to leave Canada to apply outland.

hi, i would like to inquire on how to apply under spousal visa. i am currently working as food services supervisor here in canada, and i would like to help my husband to go here too. he is currently working in Amman, Jordan.
