Scans of our passports, birth certificates, police / FBI certificate, marriage certificate, joint bank acct proof, lease, insurance, years of pictures, wedding pics, income tax info. I also included my university diploma, US drivers license & state board certification (healthcare administration) & notarized letters by friends. The receipt of payment was the very last of the packet.

Is there anyway I can check the status of my application, by a number on the receipt, etc?

As others have said, that's the inland package. It doesn't make sense that they only sent back the one form.

I think you need to get on the phone to the CIC call centre and try to get back the rest of your application, especially the supporting documents. If that doesn't work within a few days, then as Canuck said, ask your MP for help.

I'd say withdraw the inland app asap just to be safe. You can't have an inland and outland app in process at the same time.

From my minute of googling, a chaha chachi is an aunt? So the adopted girl is your aunt's mother's granddaughter, that would make her your first cousin, no? I am not sure if CIC allows marriage to first cousins. Honestly I have no idea how they handle "familial relations" like this.

I don't think it's a blood relative.

Does anyone have any idea on 'minimum necessary income requirement' the sponsor needs to have? Supporting Document checklist item #19 on an outland application. I can't find any information on cic and this is the first I have read about there being a minimum income earned for a sponsor to be eligible to sponsor... :eek:

If you are sponsoring your spouse and/or child, there is no minimum income required. If you are sponsoring your parents, grandparents, or dependent children who also have dependent children, then there is a minimum.

If you travel to Canada after Sept 29th, Canada's eTA requirement will be in force. As your children are already Canadian, they don't qualify for eTAs and will not be able to travel to Canada on their Australian passports. You will need Canadian passports for them. If either is under the age of 2, you can apply for a Canadian passport concurrently with the certificate app. If they are over 2, you will need to first wait for the certificates to be sent before you can apply for passports.

If you go to Canada before Sept 29th, the children will be able to travel on their Australian passports. However, without proof of citizenship, you may face issues getting them provincial health care.
A work-around for the eTA requirement is crossing via a land border from the U.S. on their Australian passports, if they don't get their Canadian passports quick enough.

When it comes to letters from family and friends stating that they know of our plans, do they have to be, like, slow-mailed and stamped and signed? Or are printed emails acceptable?

As much as it's thought to be wrong or distasteful here in Canada, first cousin marriage is not actually illegal, so CIC cannot take that into account. It is still very common in countries/cultures with arranged marriages.

The best thing would be affidavits (given under oath).

I am applying outland as a US citizen.

Is it a better idea to wait and submit a FULL package (unfortunately I will be waiting for my police clearance and marriage certificate for another 7 weeks).

OR

Should I submit everything I have so far? eg. Application, pictures (proof of relationship), payment/receipts, medical..etc?

My work permit expires at the end of December and I would really really like to have my PR ASAP.

the only items that can be withheld from your initial application package are the medical exam receipt, the police clearance and the payment for the right of permanent residency fee (RPRF). if anything else is missing, it will be returned back as incomplete. you need to include both the sponsor and principal applicant applications, sponsor and principal applicant fee receipts, and relationship proof all at one in the same package. You will be able to send the police clearance, the medical exam receipt, and the RPRF receipt upon request from the visa office. not submitting these items upfront may or may not delay processing of approval.

Do your best to submit everything at once to avoid delays. However, if it is really just a matter of waiting for the marriage certificate and police clearances, it is not so clear that the application would be returned to you without those.

I think there is a real question here. CIC is not legally permitted to consider an application "incomplete" and return it to you just because you have not provided everything they have asked for. There is a certain minimum threshold that must be met that forces them to accept an application, even if it doesn't contain enough material for them to approve the application. Here is what Manual IP 2 says:

5.12. Sponsorship application and minimum requirements
R10 describes an application including the minimum requirements for information and
documents required to accept an application, with specific reference to sponsorship
applications in R10(4) ,(5) and (6).
Table 10: Minimum requirements for a sponsorship application
A sponsorship application must include the following:
IMM 1344AE completed with all information requested and signed by the sponsor
A signed undertaking (part of the IMM 1344AE)
Information prescribed in R10(1) and (2)
If a representative is retained, a completed “Use of a Representative” form (IMM 5476)
Evidence of payment of applicable fees

5.13. Minimum requirements for applications
R10 describes an application including minimum information and documents required
to accept an application.
Table 11: Minimum requirements for an application for permanent residence
IMM 0008EGEN signed by the applicant

Based on my reading of this, it is difficult to see how they could refuse to accept the application because of a missing marriage certificate. I think you would have time to provide it later.

That being said, I don't know if this works in practice.

You might also consider applying inland. In that case you can continue working on your work permit beyond its expiry date as long as you're waiting for your PR application to finish processing. In that case you would absolutely have to apply before it expired. You could also apply for an open work permit under the pilot program. That would take about four months to come through.

Are you sure that marriage certificates can't be sent in later?

I'd be interested in knowing where CIC says this, or at least if anyone has had their application returned for this before.
