For inland, both must reside in Canada. For outland, only a PR sponsor must reside in Canada.

As was mentioned, your spouse can leave Canada to live in another country and submit an OUTLAND application. However if you are a PR (not citizen) then in order to sponsor you must be residing in Canada during the entire outland application processing.

Hi Everyone,

In November 2014 I ( PR, with No PR card but with blurry IMM 1000 and Verification of Status stating my status and a little bit more than 2 years and seven months of residency in the last 5 ) will sponsor my son (4 y.o) and my wife (actually having a close work permit expiring on Feb 2015).

She has double Citizenship, Italian and Polish.

We decided to apply outland (roughly 2 months my evaluation) and roughly 8 months the second stage.
Beside this, at the beginning of January 2015 she wants to extend her work permit for the same company that she's working right now so she can keep working until she will receive her PR (roughly and hopefully for Aug/Sept 2015), and I will extend my son Visitor permit so he can keep studying (JK ... cool).

1) My first question is related to her TFW extension:
Does she need another LMO?

2) On the form IMM 5481 (sponsorship evaluation) there are many question for previous undertaking which I never had, on the second page I've entered N/A for all the boxes, because the 2 persons I'm sponsoring are on the IMM 0008, My wife Principal Applicant, my son her dependent, is this correct?

For now I don't have any other questions.

hey guys, I'm new here, I was reading a lot of questions but still haven't found all the answers i need, so if you could answer my questions i would really appreciate it.
I will receive my PR in about 2 months, my girlfriend lives in Mexico and she wants to come here to live with me. we met in canada this summer, when she was studying french here for 2 months.
I live in Quebec.
We want to get married here and apply for sponsorship and residency for her.
so i have a few questions:
1) if she comes as a visitor, can she stay after her visa expires, or can she renew it, for that period?
2) if Im 20 years old, and i didnt work before, and i will only start working now, so it will not even be a year, will i have problems with that? can this be a problem for sponsorhip?
3)and also if i visit her in mexico can we get married there? or it only should be in canada, only that way it will be official?
4)also is there any differences for quebec process of sponsorship?
5) does she need to do a medical exam here or in her country?
6)and the last question, is maybe you can suggest me something else i can also do to be sure and secure about everything, I dont know because i have so many thing im worried about. maybe you can give me some advice or something that i have to do in those 8-9 months before she comes and we get married and apply for sponsor

I can't answer all your questions but I will answer what I know.

1. If she visits you in Canada she can stay by extending her visit. She should NOT stay with out doing anything because then she would be in the country illegally. There is no point in digging a hole where there isn't one. Here is the link to extend visitor stays.

2. There is no income requirement for spousal sponsorship. (Since you mentioned you are planning on getting hitched).

3. Yes you can get married in Mexico. You will need to have your marriage certificate officially translated to English or French and you need to attached a certified copy of the original.

4. Yes there is a slight difference. I know there is an additional step in Quebec. I can't answer more than that because I am not familiar with the Quebec process.

5. Medical exams can be done in Mexico or Canada. They need to be done by one of their panel physicians. Here is the link for finding a doctor.

6. You will have a lot of reading to do. I recommend starting with all the links I have shared. You will also need to start gathering evidence to prove that your relationships is genuine and ongoing. DONT FORGET she will need a police check as well.

If you were being sponsored as a spouse, there would be a 5 year waiting period before you can sponsor a new spouse but obviously this doesn't apply to you. Other than that, there is no waiting period to sponsor. The requirements are that you must be residing in Canada, you can't be on welfare and you can't be in active bankruptcy.

There is no specific income requirement but to satisfy immigration questions about your income, you should explain and you have just started working, send copies of your last 3 pay slips at the time you apply as well as a bank letter from your employer. A bank letter is just a letter that states when you started working and how much you make per hour. They are called bank letters because you mostly need them for the bank, to apply for a credit card or overdraft but they can also be helpful to tell immigration when you started your job and how much you make. Even though there is no specific income requirement, immigration should not think that you are going to end up on welfare when your wife joins you.

Hey everyone, So our first stage has been approved and we have gotten the fingerprints and photos needed to get the Informe de datos registrales. Do we have to get a background check for Canada too now that she has been here for over 6 months? Just wondering when we send all this to the embassy in mexico city will they forward this to Mississauga where our application is being processed? because according to the email we have to have it sent to case processing centre by jan 1/15. Also we want to apply for an open work permit, I cant do it online because my wife's visitor visa has expired and she is under implied status. In the work permit package it says we need a stamped imm 5401 receipt, since i paid for the Right of Permanent Residence Fee (RPRF) online is that the reciept they are looking for?

no -generally, canada background checks will be requested by CIC if they are necessary. I am a bit confused if your wife has applied outland or inland? If she applied outland (through mexico city), then she wouldn't have implied status, nor would she be eligible for an open work permit. if she entered on a visitor's visa and it has expired, then she is now out of status. sending in a PR application alone does not give anyone implied status. if she applied inland, then she wouldn't automatically have implied status because she sent an application. She would need to have had sent in the open work permit in with her PR app to get implied status. it doesn't sound like she has even applied for it yes, so I don't understand how she would have implied status on a visitor's visa? To me, if she's in canada, it sounds like she is out of status right now, unless there is information that hasn't been shared yet?

Yes sorry i got the terms wrong, she is out of status and we applied inland, as the email we got last week, we were told to get the police check for mexico which we are almost ready to mail to mexico. The email also noted that she is out of status but also says that we can apply for an open work permit if we havnt done so already. it states at the bottom "Please note that, due to your lack of legal temporary resident status in Canada, the issuance or a work and/or study permit will not confer temporary resident status." I paid the Right of Permanent Residence Fee (RPRF) is that the receipt needed for the open work permit?

No. There is a separate fee for a work permit. The RPRF is the fee for becoming a permanent resident.

It's a strange way to word it. With the work permit, she can work and remain in Canada. Fortunately, legal status is not a requirement for the in Canada class applications.
