Hello .. I am separate from my husband more that an year ago and I am currently in a conjugal relationship since then , however my partner is not Canadian , in fact he applied for refugee in Canada a couple
of years ago and it was denied , so he has a deportation order, and he still in Canada , so I want to sponsor him, I am a Canadian citizen but legally I am still married , however my actual partner and I have been leaving together for over a year .. can I sponsor him even though I am not divorce ?? what are the chances of success in this case ???

If you have lived together at least 12 consecutive months, than you are officially common-law and can sponsor him as common-law partner, not conjugal. You are allowed to be common-law even though you have a previous marriage still on paper.

You will need to show:
- proof of 12 months cohabitation
- proof that you separated from former spouse

Note that sponsoring him may not stop the deportation order from being enforced, even if you apply inland.

You should include both. The generic goes with the sponsor and the country specific goes with the principal applicant.

Hi, I'm a PR card holder since 2002. In January 2014 i got married in sri lanka and i want to sponsor my husband who is currently living in sri lanka. i'm self employed. when i asked my lawyer he said if you are self employed you can not sponsor.

My question is: Will I be able to sponsor my husband even if i'm self employed?

Yes. Your lawyer sounds like a complete idiot when it comes to immigration. You can be self-employed, a student or even unemployed, as there is no income requirement in family spousal sponsorship.

So go ahead and proceed with your app. And definitely do NOT use that particular lawyer. In fact, no lawyer is even needed as most people do the entire application themselves.

Hey guys, thanks for the earlier help! Little by little we're starting to figure this stuff out and with any luck we'll be submitting the application soon!!

We've run into another situation that we have no clarity on and the Canadian Embassy is less than helpful here in Peru. We were living in Mexico for 12 or so years before Peru, but we're making the application from Peru and we do/will need the police clearance from Mexico as well. Does anybody have any clue how to go about this? Do we submit the application without this and wait for the embassy to request it, do we fly there and get something in person? Anybody have any experience getting the police clearance for Mexico from outside of Mexico to make an outland sponsorship application?

This seems to be the last major hurdle so it'd be awesome if somebody could lend me their hand as I need to leave back to Canada at the end of August and absolutely need to submit this application before I go back home.

Yes - you definitely need a police certificate from Mexico.

Have you seen the instructions on the CIC web site? They give you information on what you should do to obtain the PCC if outside of Mexico:

I am not sure if it's been asked already, but does anyone have an idea why the timing for the 1st phase jumped from 30 days to almost 2 months? Does this happen often? I am wondering if a phone call to our MP or even the Minister will help get it back to the 30 days.

it's varies throughout the year and depends on a number of factors, mostly the increase of applications during certain months. it will probably go down at some point again. Also,it's a safe bet having ALL inland applications transferred to the mississauga office put some delay in the processing. Calling your MP will have NO effect on the processing time. For the majority of MPs, they are only willing to help out if the applicant is outside the processing time posted online. I highly doubt they will care at all about processing times increasing.

Hello everyone, I need some urgent help on few questions.
I'm filing for my spouse sponsorship from inside Canada.
1) Is English language proficiency test results [IELTS OR CELPIP] required?
2) The Document checklist IMM 5443 doesn't say to fill out Supplementary Information form (Details of foreign travel) but when I filed for my Permanent residency I remember I did filled out this form though it was not part of the checklist. Can anyone please confirm do we need to attach this form?
3) My wife (sponsored) has a full time job and I (sponsor) is only one asked to attach the job letter,
Can she attach her job letter to show her earnings as well?

Please share your experience on Any common errors in filing, things that can slow down the processing speed or could potentially reject or return the file.
I really hope senior members can help me answer my above questions.

U dnt need to have a job to apply for ur spouse...if u do its a good thing but ur spouse should not have a dependant child of her own ...cause otherwise u need to prove financial support nor should u have a dependa t child od ur own.
