Write "Open Work Permit - Please Process when AIP is granted" on the top. This is a generic form so write "N/A" anywhere that doesn't apply.
We just submitted did one of these forms to extend her stay as a visitor in February.

Im assuming we need to complete all the steps again for the "open work permit"?

Just to clearify, does this form need to be completed in order to start working after AIP (Stage 1) ? If this form was not submitted and my common-law gets AIP, she cannot work till Stage 2 or submitting this form?

Im sorry if im not making sense.. I hope someone can help us clearify this. We were just about to submit our application without this "open work permit" form but while anticipating to work after AIP.

Hey All,

I would love some guidance on this as I have read various things in regards to implied status and post graduate work permits. I am from a visa exempt country, my post graduate work permit is about to expire in July 2013, I have applied for an Open Work Permit along with my inland Permanent Residency application in March of 2013 through spousal sponsorship.

My question is do I get implied status and can work until I hear back about my spouse being AIP or because a post graduate work permit is not extendable therefore cannot be given implied status? I am currently working right now for an employer, but do not need an LMO as far as I know because I am on a post graduate work permit.

What are my next steps? Do I need to apply for another temporary work permit? Would that give me implied status?

Any help would be much appreciated!

This is a much debated topic. I'm going to say no. IEC visas are not extendable, therefore ineligible for Implied Status. If there is a gap between your IEC visa and OWP, you'll need to stop working - maybe take a leave of absence if possible.

Can you elaborate as in why its a debated topic? Have their been people who have worked past their expiry date or have they stopped working? I still have time to apply for a new work permit and get that...

A lot of people believe you can get Implied Status with the IEC and OWP. I don't know if they're confusing "extendable" and "renewnal" or what. There's been some lively discussions about it. However, our most knowledgable users say no and I've now heard about a case where the person who used "Implied Status" excuse got deported :eek:

Okay, good to know, thanks. Can I get my employer to get an LMO and then apply for a new work permit? Any other options for me to keep working? I have time to get that. I most likely won't get AIP until at least a month and a half from PGWP expiry.

Yes, definitely.

IEC and PGWP aren't the same thing, although they are both not extendable. So same idea. I apologize - too much studying today has made me cross eyed.

If I don't get the LMO in time can I just apply for a new work permit and say my employer is getting it. Can I still work?

Inland! We are in Nova Scotia

Just mentioning..

We are married and my wife is spnsoring me.
We almost have completed and gathered all documents for the application.
Next week is my med exams.

Apply for the open work permit at the same time, same application form. There is no form to apply for an open work permit. Use the form for temporary worker-change of status. You can checkmark new employer at the top but on page 3 pick open work permit and write "open work permit requested upon first stage approval".

Doing this gives you implied status so you do not have to leave Canada or apply separately to extend your stay. You can not work until you get the first stage approval and open work permit approved, takes about 6 months.

I have a question regarding the chatlogs (as proof of relationship),
Do they really need to be translated? Upon checking i have 1,500 pages worth of chatlogs from skype and facebook and it will cost alot to have them translated and even notarized.

You can use the Canadian address. Just remember, he will need to go to India or have someone else carry his passport to the NDVO. Make sure he has plenty of time left on his status because NDVO holds the PP for a long time.

First, I'm going to recommend NOT sending in 1,500 pages of chatlogs. Print a sample (1 per month is fine) and then take a screenshot of the chat archive showing all the other chats. IO does not need to know everything you ever discussed. They do need to see regular contact. You can google how to locate the archives for your chat program. Make sure to label who is who if you use handles instead of your names in the chat. You can translate it yourself IF you have other proofs that are translated. (AKA, this is a secondary proof.)

For Facebook, instead of copying all the chats, do your Wall-to-Wall aka "Friendship" with your spouse. Then you can highlight mutual friends, such as family. I copy/pasted everything into Word first to delete excess space and remove a ton of the game requests we gave each other. (IO doesn't need to see 100 Candy Crush invites!). Took screenshots (using Snipping Tool) of engagement and marriage announcements on Facebook.

Think quality, not quantity especially if your case is fairly straightforward.
