1) Leave Canada immediately and wait for the processing to be completed. (this may be your best option).
2) Apply for restoration of status, somehow. (I think you only have about 50 days left to do this).
3) Remain in Canada without legal status. (I'm not sure that this is a good idea with an outland application).
You don't apply for a work permit after 2nd stage with Outland, 2nd stage is when you become a PR, so you don't need a work permit.Benno2013 said:If any one clarify the following that would be a huge help!

4. So I called CIC: The response was the following -

To get implied status, yes I would need to apply before WP expired however because of the time frames of co habitation and the expiry of current counterfoil being the same day, it would essentially be too late to post the application for PR as documents need to be dated a minimum of 12 months to satisfy Common Law requirements (she said hypothetically that if the application could be sent and received by CIC on the SAME day as my WP expiry then technically yes I would be in implied status).
b.) I asked about a BOWP as on the cic site It says I can apply for a BOWP under the IEC stream. She said it was possible however my employer still needs to submit an LMO which I have tried before and for my role as a retail assistant they will not submit one as any Canadian can do my job.
I guess what i'm asking is
1. Can we send our PR application sooner than the 12 months required (like a week before) for spousal sponsoship with a letter stating our intentions so that I can then be under implied status and keep working? Because by the time they receive the application we will have been co habitating for the required 12 months. I feel like its a long shot.
2. Can anyone see any other option around the BOWP?
The minimum processing time for first stage approval for inland applications is currently 11 months - I cannot go this long with out an income. I feel my only option is to go to NZ after Nov (after 1 year of co habitation) and apply outland so I can keep working and then once / if approved I come back to Canada.
We are grateful for any advice. We thought we had it sorted and now we feel we are back to square 1 and time is running out fast.
