yes, a PR applicant can be IN canada as a visitor, worker or student when an outland pr application is being processed. being IN canada certainly doesn't make it "faster". there is no way to make the process "faster". the only thing to do to ensure no delays in processing and to avoid an interview is to submit a complete application that leaves no doubts in the immigration officer's mind about the relationship. Each visa office outside of canada has their own timeline for approvals. the times posted online are NOT accurate and should not be used to determine how long it will take. for 2014, some visa offices approved applicants in 3-6 months while most applicants seem to be approved within 8-10 months, somtimes a bit longer. How "fast" an application takes to process depends on where the applicant is from and which visa offices processes the application.

I just wanna make sure I get this right, we apply while still in Italy for his PR. While we are waiting, we can go to Canada and we can apply for his open work permit ( someone else mentioned this). OR do we apply for open work permit while still in Italy as well? I really appreciate everyone's help.

if he is applying from italy, therefore his application presumably will be processed at the london visa office, he is NOT eligible for an open work permit. only INLAND applicants can apply for OWP, and he will not be applying INLAND. it is a completely different application, and is not recommeneded for visa exempt applicants to apply inland at this point. as an outland applicant, yes he can enter canada as a VISITOR and can be there while his application processes. it doesn't matter where he is, italy, canada or anywhere else in the world. he is just not eligible to work in canada until he is approved for pr or a work permit initiated by an offer of employment by a canadian company.

Which form would you submit for this? I am a canadian citizen and my husband is american. I have an american PR but I have a job offer in canada so we want to move back. I'm just unsure of which category this falls into

My husband submitted the spousal application around Nov. 17, 2014 and we have not heard anything yet... he also submitted the OWP application and in Dec. the good news of the one yr OWP Pilot program came about. Has anyone received their OWP yet?? Or an AOR? How long do you usually have to wait?

It has been over 65 days and we have not heard anything. Given the estimated processing time is 61 days what is the best way to contact the Missassauga Case Centre or anyone about our application? We can only find postal addresses

you will need to call the CIC call center, as there is no direct number for mississauga. There was a recent thread with the phone number provided. it is quite possible they have not gotten to your application yet. there are quite a few people waiting beyond the posted 61 days. plus, it's important to remember CIC has not had full work weeks for 2 weeks now, so delays over the holidays are inevitable. i would recommened finding the thread for the month you sent your application in, as it is probably tracking applicant progress. currently, CIC is working on mid-october applications.

There is no form to submit. You should include a copy of the job offer and any other proofs you have, such as letters from family and friends confirming you are returning, evidence that you've looked for a place to live in Canada, proof you're tying up your lives in the US (selling house, leaving jobs etc.).

No, you cannot get an OWP. You applied outland and your app will stay outland regardless of where it's processed or where you are.

The only way to get a work permit is to find an employer willing to go through the LMIA/work permit process.

I would think a lot would depend of whether you had met your residency obligations as a PR?

Today I talked to the embassy in Rome and I called Immigration Canada. Basically, they've both advised me to go to Canada, my husband as an Italian has a right of 6 months as a visitor. In these 6 months, he needs to find a job and apply for a work permit with a job offer. We will apply for his PR right away here in Italy and then wait for that to come through.
My concern is how easy will be for him to find a job offer and an employer willing to do LMIA?

Since we are not going until June, we will start looking for a job for him and hopefully find someone to give him an offer. If not, we will have to do it all inland.
