Hi,

I hold a PR in Canada since 12th July 2008 and was a resident in Canada until 30th October 2009. Post it, I settled in Singapore and have not been to Canada since then. My PR expires in Sept 2013.
I am planning to come back to Canada for good from July 2012. I have few concerns...My husband holds an Indian passport currently residing and working in Singapore. If I have to sponsor his PR..

1) Do I need to be employed in Canada to sponsor my spouse for PR or will the financial ability be enough? (I quit my job in Singapore to settle in Canada last month). Can my spouse apply for his PR sponsorship as soon as I reach canada in July 2012?

2) Is it advisable for my spouse to visit Canada (for about three weeks) while the sponsorship application is sent out? If yes, what kind of visa is advisable for him to ??

3) My previous stay in Canada was as a student (for 3years). Do I need to make tax returns for all 3 yrs in Canada? If yes, what do I need to do? Do I need to attach it in my spouse PR sponsorship application?

4) I do not have any bank accounts, joint bank accounts, rental bills in Canada. But I do have it in India and Singapore. Can I show the status of our relationship with overseas account details or do I need to create one as i reach Canada in order to clip them along with application?

1. No, you don't need to be employed to sponsor him, showing your ability to support him based on past work history, savings and current job hunting (if applicable) will help.

2. It is extremely difficult for non-visa-exempt spouses of Canadian citizens/PRs to be approved for visitor's visas. You should be aware that once you are approved to sponsor him, New Delhi will request his passport and keep it until the issue his visa, so he would have to return to India to submit it as he cannot post it overseas (this is illegal).

3. Yes, you need to file your tax returns with CRA. Don't send them to CIC, that is not their area.

4. You may establish your relationship based on your time together overseas.

Hi

I have a issue. I have not filed tax for the year 2009 as I was out of canada in November 2009. Wonder when I can file tax returns. Is it done only in Mar-April of every year or can it be done any time of the year? Also; wonder if it would be ok to send the spousal sponsorship application with out 2009 tax returns?

You can still file your tax returns late but of course it is better to do it on time. I don't think you need your 2009 tax return to file for sponsorship. They ask for the information because they are more concerned that you and your husband will be able to support yourselves in Canada so send them a few of your last pay slips to prove that you were working in Singapore and include a letter stating that you do not have a current Canadian tax return because you have been outside Canada since 2009.

or is it ok to just show my 2007,2008 canadian tax returns and my 2010 and 2011 singapore tax returns?? pl. advice

Why do you feel you need to show 5 years of tax returns?

True, you should have filed your taxes for 2009 but immigration and Canada revenue service are not the same branch of the government.

God, I even called the CRA to help me file the tax. Talked to them for an hour and did not understand a word (the terms that they use for tax returns). Finally, they asked me to ask my school to give info regarding my scholarships and part time jobs which will help me file my tax. Anyway, I will go ahead and file the tax as that is disturbing me...

So you mean to say, I can show them the Singapore tax return for 2011, 2012 for the spousal sponsorship, isn't it?

Yes, you need to be employed, cause they want to know that you have a stable job and a minimum income. Doesn't matter what you make, as long as u got a job then you're okay. You may also need a job letter from your employer indicating the day you start working, $/per Hour, and hours you work every week. They don't ask for financial statements or anything like that. I just went through the same thing 2 months ago

They don't care about how much you made in the pass, what they mainly concern with is your 2011 return. Nothing else... But hold the 2010 too just for safety.

If you live in Toronto i can send you to one i used... she charge 2820 dollars (tax including) and then theres a extra 1040 dollars for for the immigration ppl to process the paper, and in that fee, u paying for the PR card too, so if u get approve he gets the card ship to him right away

Ohhh and price range from 2500 - 3000 without tax.

BTW, my lawyer finish everything n mailed in in 2weeks if i consolidate the days

All was done online, Im only 21 BTW

Hi Leon,
My spouse (who will be the applicant) and I (who is the sponsor) are living together in Singapore. I plan to apply for my spouse sponsorship as outside canada application. My spouse might come along with me (who is the applicant) to canada in tourist visa for 2-3 weeks to help me settle in Canada plus he need to see the place before making the big decision. Once my spouse leaves canada, is when we plan to sent the application to New Delhi office. However, to save time, thinking if we would sent application while spouse is in Canada (during that 3 weeks vacation time), for an outside application in canada (New Delhi). Is it advisable? or would there be any issues with it?
