Hi Gang,

I am asking this on behalf of someone I know. His English isn’t good.

He is currently working as an ubereats and Skipthedishes food delivery driver. However he has not been paying taxes on his earnings.

He is a PR holder.

He was told that because he hasnt paid taxes he wont be able to sponsor his wife and bring her to Canada from abroad. He was told he won’t even be able to apply for a visit visa for his wife.

He was told that his application would be rejected because he hasn’t paid taxes on his earnings.

Is this true?

Well, one thing, he is committing tax fraud by not reporting his income.

Second, if he never reported any income, in IRCC's eye, he has NO income. So how can he support ad sponsor his spouse?

Who told him that? I don't believe that automatically prevents someone from sponsoring a spouse.

`You may not be eligible to sponsor your spouse, partner or child if you:

  • you have already applied to sponsor the spouse, parent or child you are currently seeking to sponsor and a decision on that application hasn’t been made
  • are in jail, prison, or a penitentiary
  • didn’t pay back:
    • an immigration loan
    • a performance bond
    • court-ordered family support payments such as alimony or child support (not applicable if you live in Quebec)
  • didn’t give the financial support you agreed to when you signed a sponsorship agreement to sponsor someone else in the past (not applicable if you live in Quebec)
  • declared bankruptcy and are not discharged (not applicable if you live in Quebec)
  • receive social assistance for a reason other than a disability
  • you were convicted of attempting, threatening to commit or committing a violent criminal offence, any offence against a relative or any sexual offence inside or outside Canada
  • can’t legally stay in Canada and must leave the country because you received a Removal Order

There may be other reasons that make you ineligible to sponsor your spouse, partner or child. If we determine you’re not eligible to sponsor, we’ll tell you why.'

True, for part 1. Part 2...maybe not:

`Income requirement

In most cases, there isn’t an income requirement to sponsor your spouse or partner or dependent child. You only need to show that you have enough money to meet the income requirements if:

  • you’re sponsoring a dependent child that has 1 or more dependent children of their own, or
  • you’re sponsoring a spouse or partner that has a dependent child, and their dependent child has 1 or more children of their own.'
I do agree that the sponsor would have to show at least some way of supporting his spouse.

There is no "hard number" on the income for a sponsor. But they need to show how they will support the spouse once they moved to Canada.
So if the sponsor has enough savings or is living at parents place for free, that maybe easier to proof.

Again, friend is not ineligible to sponsor. But he won't be able to show that he can support his sponsored family here. Maybe it will still be approved. But it depends on the officer looking at the case.

So what I meant was that friend should be applying as if he has no income and he needs other proofs
