Hello,

Can anyone advise me on the below concern:

I am a PR in Canada and I have never been married, my fiancé is currently in the US but has an illegal status. We plan to get married later this year, but I am wondering if I would be able to sponsor her application while she remains on the US. Would she be able to do biometrics and other requirements for the process from the US, considering her status or she would have to return to her home country.

Please share your thoughts.

Yes, you can sponsor her while she remains in the US.

Note that you must be in Canada at the time you submit the PR application and must also continue living in Canada while her application is processed.

Make sure you are 100% honest about her status in the US and also include strong relationship proof.

If she has been out of status in the US for more than 1 year, she will be banned from the US for 10 years as soon as she leaves.

Yes, she can do biometrics in the US. Make sure she has a valid passport. Note that the 10 year ban will remain in place even once she becomes a Canadian citizen.

When you say strong relationship proofs, what you advise I make ready for the application - text messages?, fund transfers? etc.

I'd recommend you dedicate some time to reading through the posts in this section of the forum to see what others have included.

Given her status in the US, you want to avoid a super simple court wedding with no reception. You'll be much better off with a full reception with friends and family members from both sides attending.

Proof both of you have met each others parents and family.

Any evidence of trips together.

Communication evidence is certainly good.

Joint assets and bank accounts would be ideal. Fund transfers are OK but can appear one sided. Joint assets and accounts are better. If you happen to have lived with her together in the US, then joint leases, joint utilities, etc.
