Hello everyone,
I typed here before, sadly our conjugal partner sponsorship was refused. reason, they say at interview that we apply under the wrong category because my sponsor could have lived in Colombia for a year an applied under common law. so VO say that he should move to Colombia ( which is impossible for us ), maybe get married and reapply or appeal. We are planing to get married in a couple of months in Mexico City. but we are a bit lost if is that legal for an immigration porpoise under the canadian law (I'm Colombian my partner is Canadian) we are exited about this event our families are travelling with us. but the question is, We could apply under the spouse class if we get marry in Mexico?

Yes - if you are legally married in Mexico as a same sex couple then you can apply under the spousal class.
 
It doesn't matter where you are applying. As long as you were legally married in the country you were married in - the marriage will be seen as legal for Canadian immigration purposes as well.
