Spousal Sponsorship REFUSAL - PLEASE HELP

I used an immigration lawyer for my spousal sponsorship application (which I highly regret since my case was fairly simple). I applied in July 2020 and finally received a letter in regards to paying the permanent residence fee $500 in December 2021. In February 2022 I received a letter from IRCC stating that my husband should complete biometrics. In March 2022, I received a letter from IRCC asking if I was in receipt of social assistance ever since I submitted my application back in July 2020. I was on social assistance from June 2021 to August 2021, I paid back OW the money I owed them. OW sent me a receipt stating that I've paid back everything, however they wrote down the wrong amount that I paid making it seem as if I was about $3 short when in reality I paid back everything. I didn't see the mistake on the letter and my lawyers didn't see that either they ended up sending that receipt along with a letter they wrote to immigration. Two weeks later, they sent me a letter stating that their concerns wasn't satisfied because I didn't pay back social assistance. I want to reapply again and do it myself without my lawyer however he's saying that my case is complicated and they want to charge me $5000 for reapplying... that's crazy. My hubby is overseas and I've been raising my son alone, I cannot afford this amount of money but I'm also scared that I'll miss something so minuscule in the application .


I don't know what to do someone please help I need some advice.

They think that the officer made a mistake. My case was fairly simple except for the fact that I took welfare.

But the sponsor can't take welfare when sponsoring the PA, so they didn't make a mistake.

I think you'd get far better information by sticking to one thread so that all can see the case with all facts and the answers already given.

But the sponsor can't take welfare when sponsoring the PA, so they didn't make a mistake.

I meant to say my lawyers think the officer made a mistake when he/she stated in the letter that the amount I took from welfare remains unpaid. The receipt that the agent from welfare sent to me stated that I paid everything in full but the wrong amount was written on the receipt which made it look as if I was a couple dollars short. Example, the amount I owed welfare was $2707.60 but the welfare agent wrote I paid off $2703.00 my balance has been cleared. This probably made the officer think that I still owe welfare money which I don't, however, the immigration officer could've done the proper investigation but instead refused my application solely because I didn't pay welfare back. This is the mistake my lawyers think the immigration officer made.

I'm not shopping around hoping for a better answer, I would just like to see some different opinions, I don't think that's wrong right?

The issue is that you were on social assistance during your application process so you were refused. That is an automatic refusal. Yes, you paid it back so now reapply and show that you are working and no longer need assistance.

You can choose not to answer this, but instead of going to welfare, why the applicant didn’t send you the money when you were in need?
Also, the sponsor promise as per the agreement to support the applicant for 3 years without going on the government support.
Such questions could be raised in your new application, hence you should wait for a few months before applying again and in the meanwhile, create a good income source to show in the new application.

I was not referring to getting a second opinion from your lawyer, but establishing multiple threads. Keep it simple here. Please.

I just finished my maternity leave, do you think its best that I wait to get a job first before I reapply? Or do you think I should show savings and reapply?

I think, you are complicating things.
If you already had enough savings then why did you chose to go on welfare?
If I were you, in order to not get many questions asked in the new application process, please try to get a job before applying so that you can show 2 income sources including salary instead of just savings to support your case.
You should try to simplify and resolve the issue which caused you first application to get refused.
