Bill C-6 Amending Canadian Citizenship Legislation Passes Senate

A bill to change Canada’s Citizenship Act has finally been passed by the Senate with amendments, bringing the legislation closer than ever to becoming law. As a result of this bill, immigrants to Canada would be able to apply for Canadian citizenship earlier and more easily than before.

In a vote of 45 for, 29 against, and zero abstentions, Bill C-6 passed the Senate at around 4 p.m. on May 3, 2017. Senators in Ottawa have asked their colleagues in the House of Commons to review the bill, including amendments added by the Senate after the draft bill was previously passed by the House of Commons in June of last year. The bill must receive royal assent before becoming law.

C-6 reduces the amount of time permanent residents have to live in Canada in order to become eligible to apply for citizenship, from four out of six years to three out five years. In addition, applicants who spent time in Canada on temporary status — such as on a work or study permit — would be able to count a portion of this time towards the three-year requirement.

The bill removes the intent to provide provision, and an increased number of applicants would be exempt from language proficiency requirements. The bill passed by the House of Commons last year placed an age range of 18 to 54 for language testing, but this was amended to 18 to 60 in the Senate following an amendment tabled by Independent Senator Diane Griffin.

While being read in the Senate, Senators passed a number of other amendments to the bill. Among these were a provision requiring the Immigration Minister to inform individuals who have their citizenship revoked due to fraud or misrepresentation that they have the right to appeal the decision in Federal Court. Bill C-24, the Strengthening Canadian Citizenship Act introduced by the previous Conservative government, removed the right to a Federal Court hearing for individuals subject to revocation of citizenship in cases where it was found that citizenship was obtained by fraud. Since C-24 came into effect, affected individuals have 60 days to respond in writing after being informed that their citizenship will be revoked.

Another amendment, tabled by Conservative Senator Victor Oh, would allow minors to apply for citizenship without assistance from their parents. Under existing laws, parents and children are treated as one unit when applying. If the parent’s citizenship application is rejected, the children or child included on the file can’t get citizenship either. In such a case, the child has to wait until the age of 18 to make another application.

“While it took almost a year to be passed by the Senate, that institution has stepped up to be one of sober second thought by giving the bill three readings and bringing in some important amendments,” says Attorney David Cohen.

“The spirit of the bill remains intact, however, and, if and when it becomes law, immigrants to Canada will have a quicker and smoother pathway to Canadian citizenship.l

Hello need help!!

As I already mentioned that my application was submitted by a lawyer so he recieved a letter in his email on 30th March. The problem is he got busy with ither stuff meanwhile and didn't check the email. Today he contacted me and informed that there is this letter from lvo and I need to be quick in replying the letter. Now My spouse has almost 10 days to contact lvo :o he kept saying tell your spouse to check the email but he gave his own id in the application and I didn't know that.

They requested a bunch of documents:
For my spouse:
Attested English translation of nikka nama, the one I sent before doesn't suffice
Copy of walima invitation, booking receipt etc
Additional photos with sponsor,
Passport stamps and itineraries
The reason why I didn't visit Pak to meet my spouse for this long period and why I submitted for it late
Evidence of communication throughput the time
Police certificate

For sponsor:
Passport copy including exit/entry
Evidence of spouse residence in Canada: tax reports, bank statement etc


Please help me with this. I don't know how to satisfy them as to why I submitted my application late and why I didn't visit Pak after marriage There were some family issues but I don't want to mention them :(

The situation is very unfortunate, but we cant do anything about it now. You have 10 days only so be quick.

1) provide everything they have asked. consider this as your final chance to satisfy the visa officer.
2) You must answer the Visa Officer's queries of why you submitted your application late & why you couldnt go. Also you need to back your reasoning with evidence (just an example: if you couldn't get vacation off from work you can include an email/letter from your boss regarding this).

Did your brother also receive any request like this?

29-Aug-16 applicant (Jpj_01 on spreadsheet) got add doc request on 03-May-17: Requested relationship photographs & passport copies if sponsor visited PA.

I think we should forget about processing timeline as I received response from LVO as below

"Dear Applicant,


Thank you for your e-mail.
The background checks are undertaken by a third party so we are unable to advise how soon they will be completed.

The processing times advised on our webiste are only indicative as each application is assessed individually. There is no maximum processing time for any immigration applications"

This response is only for applicants like us who r stuck with LVO unfortunately. Otherwise all other applications r processed within a year or less

Received my notes today and compared it with one from late Feb 2017...not a single change! Notes say PA's eligibility "due date" was March 01, 2017....and it still hasn't started >:(
