Canada introduced a new regulation that does not recognize proxy marriage on June 15 2015. Our marriage was before the new regulation. we have a child now whom I also added to the application while it was been processed. After a year and a half, our application was refused because under the new regulation, our marriage is null. We do not qualify as common law partners as we did not live together for a period of 1 year. It was short visits since then. Humanitarian and compassionate grounds was not used and the best interest of a child involved was ignored. I am planning to appeal. did anyone had/heard a similar situation and how did end? what was the time frame to appear before the appeal board after submitting the appeal?

Your marriage may have been before the new rules, but was your application sent before that? If not then your app is correctly refused and no point to appeal. It would be a lot simpler to just get married (non proxy)

Our app was sent after the new regulations. So I think it is a matter of "fact vs law". thank you for your response.

There is no point in appealing. You were correctly refused under the law.

Get married in a legally recognized ceremony and apply again.

I think you will find this to be the fastest, cheapest method of sponsoring your wife. Appeals can take well over a year and if you retain a lawyer, it can cost you bags of cash.

Hello Dear, can you please help me out, I am a Canadian citizen, in March 2018 I send a proxy paper work to my brother back home, they issued a marriage certificate under me and my wife, my wife was there. But I wasn’t, my brother represented me, then I went back home after tow months and did a big wedding with a lot of pictures, the I came back to Canada and applied for Outland sponoship. My time line is:

Mid revived July 26
Transfer to Vo Egypt July 31
SA July 31
BGC October 05
Document request Pcc October 10
Pcc upload successfuly October 24
Nothing after that ,
My question is is the proxy marriage going to effect me? I just read there was a low in 2015 to not allows proxy marriage any more? Am I going to get refused? Please

Yes, your app will be refused. Your proxy marriage is not legally recognized by IRCC.

Because I wasn’t at the singing of marriage certificate? I was at the wedding though , why would immigration wait 8 months to refuse it? Are you sure ?
 
I couldn’t go, it’s in Garza strip Palestine, I was scared to go there, I have a restaurant here, I employ 22 people, I was scared not to come back. I managed to get my wife out of there in Amman Jordan and we did our wedding there, I explains all that to IRCC,what do you think , thanks for the answers.
