I’m going to land as a Canadian permanent resident in a couple of weeks and I’m marrying a US citizen next month. He currently works and lives in Washington DC and comes to Toronto to see me every couple of weeks. He is eager to move to Canada to stay here with me so we are going to apply for family sponsorship right after we get our marriage certificate. We are not considering marrying before I land because we don’t want to risk my application being delayed/refused (my current TR docs expire in summer). I’m not from a visa-exempt country.
With the new changes CIC made in December, inland and US outland processing times are the same. We really want to go inland because that way he can get an OWP and move here sooner. With outland we would have to wait extra 6 months, and it does matter for us after two years of having to fly every time we want to see each other.
I’ve read different opinions on inland/outland eligibility. Some people say that it only determines where the application is processed, not where the applicant is; other people say that one can only apply inland if one resides in Canada. CIC website says that one can apply inland as long as one has a status (student/worker/visitor) and a mailing address in Canada.
So, with him living in the US but having a visitor status every time he comes over (I assume his status is a visitor even though he doesn’t need a visitor visa or a visitor record), can we legally apply inland? He will not be staying here for the period of application processing but it not a problem for him to fly here for an interview/medicals/etc.
Or does he actually have to reside in Canada in order to apply inland?

I’m lost and confused and torn with a possibility to move in together earlier vs. waiting another year for the outland.
