Hello

I need some information regarding spousal sponsorship inside Canada.

I am here in Canada from Sept 2013 as a student visa, as well as I have 20 hours work permit. My study permit, visa and work permit will expire on 31st August, 2015.

I got married on May, 2015 in Canada. My spouse is a PR here. Now she will sponsor me. I will apply within 1 week from today.

In this case I have some confusion-

1. Do i need to apply for a work permit separately ?
2. If yes what type of work permit it could be? How long it will stay?
3. What could be the processing time for that work permit?
4. If my work, study, and visa expire before the new work permit process, can I still work, or I need to wait?
5. What will be the status of mine just after submitting my sponsorship application from my spouse?

1. did you extend your student permit?
2. without job offer you couldn't have work permit and you cannot extend your off campus work permit if you don't go to school anymore.
3. you should check out on CIC website, it will tell.
4. if your renewal application received before your work/student permit expired (you should send via registered mail and keep the receipt as proof that you sent your renewal application before any permit was expired) you can stay in Canada legally an implied status but you cannot study or work.

I don't know much about inland application, but you can apply for OWP with your inland application.
and until you get owp (either you are approved or rejected it) you can legally stay in Canada (that is implied status ).
but you cannot study and work.

From CIC website
before you receive a decision on your application, you can stay in Canada under what is called implied status. That means the law implies you are a temporary resident

You can only get an OWP with your PR application if you are in-status, so make sure you at least renew your status as a visitor.

Implied status means you are legally allowed to stay in Canada with expired permits because you have applied for your visa. But you have to have documented status for the OWP.

I'm not entirely sure you still get implied status with an inland PR application, because then they wouldn't have the status OWP requirement. You do get implied status with work/visitor extension application though.


EDIT: Ok I found the answer "A person must include the OWP with the Inland application, prior to their status expiring."

Regardless, make sure you apply for extension BEFORE your visa expires, it has to be in their hands.

As my wife sponsoring me Inside Canada, do i need to pay "Right of Permanent Residence Fee" of $490 with the fee of $550?

You can pay the $490 later when CIC requests it. You don't have to pay it now (but you will have to pay it eventually).

If you have already made an online payment but haven't submitted your file yet, you can make another online payment and include both receipts. CIC will apply both payments to your file.
