Spousal Sponsorship inland Canada

Hi,

I am waiting for my Indian PCC to submit my file for the spousal PR inland Canada. I have applied my Indian PCC on June 14 2024 and still havent received it. My Post Grad work permit expires on august 30, 2024. Since I am travelling to India in november this year and i think i dont have enough time.
Can i submit my file without Indian PCC and later add my PCC to the file when i receive it?.

I have a TRV visa until year 2032. If i travel to india can i enter Canada in applied status since i have my TRV stamp on passport. And after entry get my visitor status changed to applied.
And Is it possible for me to get a spousal work permit from border when i have my AOR?

You cannot get an OWP at the border. This is not possible for OWPs linked to spousal sponsorship.

You lose implied / maintained status once you leave Canada.

How long are you planning on leaving Canada in November?

Is there a way to maintain my status?
No, not if you leave Canada.

I would recommend you limit your trip to 2-3 weeks if your spouse is not traveling with you.

No, you will not have maintained status. Again, if you want maintained status, then you cannot leave.

If your TRV is valid, then you can enter Canada. Of course if and how long you are allowed into Canada is always up to CBSA. Most likely you won't have any issues re-entering.

So to have implied status, you need to submit your OWP before your PGWP expires in Aug.
If you haven't submitted your application, the chance of getting AOR for the sponsorship and then submit the OWP is not high.
You will only then be on implied status and can continue to work.

So I think this trip may not play as an important step as to "maintain" a status.

You will likely need to apply to extend your stay as a visitor before your PGWP expires in Aug.
Question, why don't you apply outland since you have TRV and can travel and currently OWP is an option for both inland and outland application.

So in case you were lucky enough to get AOR before end of Aug and apply for OWP, you can only have implied/maintenance status if you remain in Canada. Any exit (even a cross border shopping day trip) will lost the maintenance status. And you cannot get an OWP via flag poling. This was never available and even PGWP or SOWP which was available cannot be done at the border via flag poling any more.
