Spousal sponsorship for deported Mexican

Hi there,

My girlfriend lived in Vancouver for 5 years, but her refugee claim was eventually denied. She overstayed her welcome, and was deported back to her home country of Mexico in January 2012. We met in March, 2012. I am a Canadian citizen living in New Brunswick with a stable, provincial government job. I've been in this position for 10 years. We are getting very serious, and are talking about marriage. However, we are both unsure of her ability to return to Canada.

I'm looking for feedback from anyone with knowledge of this sort of thing. Is it likely or unlikely that she would be able to return to Canada if we decide to get married? If we do get married, how long do you think the approval process would take before she could move back to Canada? 6 months? 1 year? 2 years?

You'll find several of us there and you can get a nice idea regarding processing times, how to prepare your documents, etc.

Previously deported persons need an Authorization to Return to Canada (ARC) which will add a few extra months to her processing time. Since she was deported. She can return to Canada as long as she doesn't have a criminal record and you guys can prove that your relationship and marriage is genuine. Expect for them to scrutinize your application more than usual.

You're probably looking at around one year if everything goes as planned. Maybe a bit less.

You'll get more responses there, that's for sure since it's a very active thread, but I'm unsure as to what you want to know so far.

As for your questions. Yes, she can come back to Canada as long as you two get married and apply through spousal sponsorship. Marriage seems to be the only route for the moment since you haven't lived together in order to qualify as common-law.

Have you read the spousal sponsorship information on CIC's website?

Of course you can bring your Mexican back. Just be prepared for lots of ups and downs. Fasten your seat belt and go for it !

Yes, I read a lot of the information on spousal sponsorship on the CIC website, but I haven't read the application form yet. Well, I skimmed it, but I didn't read it in depth yet.
