Hello everyone ,

I arrived in Canada in the year 2017 and applied for refugee , after my first hearing the status was not
granted .

understandably we went through the appeal and federal court after a negative judicial review . i was
issued the imminent notice of removal order(that had turned into a deportation order) and attended all 5 interviews with CBSA , i was offered to pay my own flight fare but i wasn't resourceful at that particular time .

i showed up at the airport where CBSA had told me to be and checked with them as i left Canada . however in the beginning of the year 2019(i was still in Canada) i got in a relationship with my then girlfriend , and we are still together, the distance sucks and we're sure we want to get married , she is visiting in the year 2020 and we are getting married by then . i am not very knowledgeable with Immigration Canada all i know is she is Canadian and that she could sponsor me "my lawyers words " and that i should add a letter explaining about my deportation and why i should be granted entrance in Canada .

I'd really appreciate any sort of advice from anyone who's been through something similar
or have expertise in such cases .

Yes - your wife can sponsor you. You will need to go through the ARC process as part of your sponsorship application to be able to return to Canada. You will need to repay the cost of the flight to remove you from Canada, as well as an additional $400 feel for the ARC. You should expect that the ARC process will add at least several months to the overall processing time of your application.

Also i've red here on the forums that some Marriages are rejected by the immigration officials when it goes to sponsorship latched on
deportees , given what you've red in my initial question and experience you have , would you say we stand a chance ? and if so
how can i improve on our chances of having it go through? it can take however long it wants i am on no pressure , all that counts is
the case passing. Thanks again Scylla

Most likely you will be under more scrutiny to prove that your relationship is real and that you did not get married just to get into Canada. Just keep chat logs, send gifts back and forth, take vacations together, meet family members.. basically everything a "normal" couple would do...

perhaps know how long the ARC process roughly takes for failed refugees, given the expertise you have on this forum and the cases
you've seen? @scylla would you know if the ARC is a separate application that is to be filed upon request or is it to be included within the sponsorship file ? All my gratitude to your responses

ARC is a separate application for which you must pay a separate fee ($400) - as well as repaying the costs of the flight to remove the person from Canada. Normally IRCC will request that you complete the ARC process at a certain point in the processing of the spousal sponsorship application.
 
How long did you date before you were deported? Did you live together? Are there any other red flags like differences in religion, age, etc. If it is a short period of time you may want visit at least once before getting married or she could even go live with you in your home country since she is a Canadian.

@canuck78 pardon my late response , i hadn't received the notification . basically the moment CBSA began interviewing me about the deportation order that was against me , i didn't force no more , i asked for a date they'd like me to leave , they promptly did. i didn't delay my scheduled removal at all, i am not quite sure if we'd qualify as living together , she'd come over for weekends , or even spends a week or two at my place .

She's spending 3 weeks here in January . and as for redflags , there is none that could strike my thoughts right now. we're 3 years apart in age difference but i guess that is not too much .
and we met at church

Hello @GodSend if i am not asking too much from you , would you know if Letters from people who actually know us as a couple would help
the case , i do tick everything you noted above but i met her family on several occasion but don't have tangible proof , ie: photos with them . i understandably didn't predict that i could need them for such a situation .

I wish all of you a happy new year . Time has arrived for my wife to submit the spousal sponsorship
I just had two questions that i would dearly need an answer for

1. I know i need ARC and repayment for flight expenses , I already paid for both of em , i have a receipt with a tally of 1900$ (400$ ARC + 1500$ removal expenses) .
Will IRCC be able to tell which amount allocates to what ?

2. I also wrote an explanation letter for my ARC and signed it, I and my wife thought that putting the letter and the receipts in the application
would be alright since they are going to ask for it anyway, we thought doing it that way would save us correspondence time . is that Okay , are we going to be asked to repay and resubmit the ARC and removal expenses ?

Is it going to be processed all together ? Or i’ll have to re apply for it later in the application ? I did it wanting to save them time of communicating the request of ARC but now i am not sure given what i’ve been reading on the forum . Please provide inputs on this if you can . Thanks

They will process the two together. Expect longer overall processing times since an ARC is required.
 
If possible due to covid another In person visit would be beneficial.

She visited last december , our application ended up being retuned for miss filled form and we just got our AOR .
We ofcourse included proof of her visit in the resubmission .
