Hi all,

I am currently filling up the forms for Inland Spousal Sponsorship. My fiancé and I lived together as friends from 2015 to 2018 and began dating in August 2018 while still living together. Are we considered common law from August 2018 or August 2019?

I am currently on a study permit, do I have to update the IRCC about this change in marital status?

Thank you.

So to clarify that when you applied for your study permit you applied as single or common law ? Are you still cohabiting since 8/2019 ?

Yes we are still cohabiting since August 2019.

I applied for my study permit as single. I had applied for a study permit extension a few times (May 2018, August 2018, and May 2019) and applied as single asI thought that we were not considered common law until August 2019.

Hi potatobeans,

You became common-law on August 2019 (1 year after living together in a conjugal relationship).

Can't comment on your question regarding updating IRCC of the marital status for the study permit; however, you (and your fiancé) should inform CRA (Canada Revenue Agency) if you haven't already done so, and file your 2019 taxes as common-law.

Not sure how far you are in the document gathering process, but we just started creating videos on YouTube sharing our experience which may help.

Good luck on your application!
