Spousal Entry Not Via Sponsorship

Does an option exist to bring a spouse to Canada but not using the sponsorship option?

We currently live in the UK - I’m British and my spouse is Canadian, but not a permanent UK resident. I understand that if he were to become a permanent resident here, we are no longer eligible for sponsorship.
In that case, can we still move to Canada in the future or is sponsorship our only option?

1. You understand wrong. As a Canadian citizen, you can sponsor your spouse at anytime that you wish (As long as you haven' t sponsored a spouse in the past 3 years). Canada recognizes dual citizenship, so a Canadian taking out PR or Citizenship in another country, has no bearing on spousal sponsorship.

I don’t understand, it says on the CiC website that you can’t sponsor your spouse if you are a permanent resident of another country: https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/family-sponsorship/spouse-partner-children/eligibility.html

Who is eligible to sponsor their spouse, partner or child
You can sponsor your spouse, partner or dependent child if:

  • You’re at least 18 years old
  • You’re a Canadian citizen, a permanent resident of Canada, or a person registered in Canada as an Indian under the Canadian Indian Act
    • If you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when the persons you want to sponsor become permanent residents.
    • You can’t sponsor someone if you’re a permanent resident living outside Canada.

I believe this is what they meant:
  • You’re a Canadian citizen, a permanent resident of Canada, or a person registered in Canada as an Indian under the Canadian Indian Act
    • If you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when the persons you want to sponsor become permanent residents.
    • You can’t sponsor someone if you’re a permanent resident [of Canada] living outside Canada.

Since your spouse is a Canadian citizen and not a Canadian PR, that part should not affect the sponsorship.

Ah I see what you mean, I didn’t interpret it in that way! That’s incredibly helpful, thank you.

I wonder if anyone on here has experience of being sponsored when their spouse was a PR of somewhere else to confirm it.

Guess this is a case of someone who prepared the guidance not viewing through the eyes of the reader given just inserting ‘or’ between citizen and PR would remove any confusion but then again confusing words are not unusual on the IRCC website.

It’s not whether someone is a PR of somewhere else it is whether as a Canadian citizen they can show intent to move back to Canada with the to be Canadian PR when sponsoring someone. So being a PR of some other country could imply little intent to move back so IRCC might need more convincing to process an application especially maybe if only becoming a recent PR of another country. Will all be about including proof of intent to move to Canada should the PR application be approved

That makes sense and that proof actually wouldn’t be an issue.

I just believed that becoming a PR of the UK would completely eliminate the ability to sponsor a spouse. I thought it strange so assumed I was missing something, but luckily just found this website and asked.
I’m incredibly glad I did as I didn’t realise it was just a word I was missing and we were planning around my error.
