Hi,

We (my wife and 3 children) have recently relocated to Canada from the UK for my work (i'm on a 3 year work permit) - my wife is Canadian.

From reading the eligibility requirements for a spousal sponsorship from my wife, we are not allowed to have any children in common (ie my 3 children) - i'm therefore assuming that she cannot sponsor me? (which I find a little unusual)

Has anyone had any experiences with this? Failing that, i'm assuming one of her parents would be able to sponsor me?

There is no such rule, not sure where you are getting that info from.

You can be sponsored as spouse no problem. Doesn't matter how many children you have.

If your wife passed along her Canadian citizenship already to kids, then they don't need to be sponsored as they are already citizens. If she couldn't pass along citizenship, then the kids can be added into your PR application as dependents.

that refers to the new rule for PR holders; they are subject to the 2 year conditional PR:
As of October 25, 2012, sponsored spouses or partners must live with their sponsor in a legitimate relationship for two years from the day they get their permanent resident status in Canada.

This applies to you if:

a permanent resident or Canadian citizen is sponsoring you,
you and your sponsor have been in a relationship for two years or less,
you have no children in common and
we got your application on or after October 25, 2012

So, this has nothing to do with you, you would not be subject to this condition because you have children in common and you have been in a relationship for longer than 2 years.

That is not your eligibility. That is the conditions under which you would get a conditional PR. Since you have children that does not apply to you and you would get full PR status upon approval.

Where are you reading? can you put the link?
Theres is not such a rule. Unless you are mixing things up, and what you read is probably the condition 21:

"Effective October 25, 2012, sponsored spouses or partners must now live together in a legitimate relationship with their sponsor for two years from the day they receive permanent residence status in Canada.
If you are a spouse or partner being sponsored to come to Canada, this applies to you if:

You are being sponsored by a permanent resident or Canadian citizen
You have been in a relationship for two years or less with your sponsor
You have no children in common
Your application was received on or after October 25, 2012"


If you DO have children in common, and you have been in a relationship for 2 years or more, then this rule does not apply to you.
