My spouse has a son, 7 years. old. His biological father never recognized his son, and never supported him. In the Birth Certificate for Father it was written real first name of his father, and last name of the boy's mother. It was a general practice for the country (Ukraine) that in case if father did not agree to recognize his parenthood, his first name and mother's last name is to be included on certificate.

So now, we are gathering documentations, and for the Consent for Immigration we have a problem. We can not take biological father for authorization because he is not on the Birth Certificate, and the person on Birth Certificate is not a real one. Mother, my spouse, has status of a Single parent in Ukraine.

My question is, would it be possible not to file Consent for Immigration motivating that my spouse is a single parent?

If she doesn't have consent from the father, then she will probably have to get consent from the courts to remove the child from the Ukraine.
