Hello,

I have got refusal as a "Skilled Worker" for Canada PR in this month. Now, as discussed with my relative in Canada, He can offer "Sponsorship" for me & my wife.

The relation is "He is my wife's elder brother, therefore mine is brother-in-law". He is leaving in Canada on PR Since 6 Years.

So, I would like to know if he can sponsor us (I & My Wife) to become permanent resident of canada.

Experts, Please advise.

Following are the list of 'relatives' that a person from Canada (Citizen or PR) can sponsor:
- children adopted outside of Canada or intended to be adopted in Canada
- brothers or sisters, nephews or nieces, grandsons or granddaughters who are orphaned, under 18 years of age and not a spouse or common-law partner
- any other family member if there is no spouse, common-law or conjugal partner, son, daughter, mother, father, brother, sister, grandfather, grandmother, uncle, aunt, niece or nephew who is a Canadian citizen, registered Indian or permanent resident or whom you may sponsor.

In your case, your brother-in-law can sponsor his sister (your wife). However, its unlikely that she would be either under 18 years or not a spouse. Hence, he would not be able to sponsor her. There may be other indirect ways, but it would be best handled by a qualified immigration consultant.

hi,
i think your brother-in-law cannot sponsor you under family class but in some provinces they have option to sponsor relatives, if they have their own business in that state ( nova scotia). if they dont have business than they can sponsor you under refugee class. you should contact a immigration consultant.
best of luck

Since they live in Ontario, they can't sponsor you. Sorry.

More information here:

http://www.cic.gc.ca/english/refugees/index.asp

You actually have to be a refugee to qualify. This means that you must be able to prove that you were personally persecuted in your own country and your life is essentially in danger. If this isn't something you can prove - then forget about applying as a refugee.

Thanks for the response. But, I am sorry that i am unable to consider myself as a refugee for canada only. Canada is a dream for everyone & specially like me guys, having ability to prove myself THE BEST in any country. But, fate is not with me that's why i got refusal for a nominal mistake in document submission as a "skilled Worker". I am going to send "reconsideration letter" to my local VO with some documents, which may help them to reconsider my PR file again.

Hope for the best. I love my country THE MOST & only thing to switch to canada is, economical stability, which is not 100% possible in INDIA as per my designation. Still i have a long way to go. That's why i said, Canada is a dream, but not a final destination.

Ont thing is sure that if you don't get any updates after working honestly with hard work, means fate is not with you. Only honest hard work is our hand,so do it & enjoy life.

Pray for me that the Visa Officer reconsider my file again.
