Sponsorship inland canada and need extend visitor status

Hello, I need someone’s help. I submitted the in Canada sponsorship application for my husband at May 28th, and the IRCC sent me email on July 10th saying they start processing. My husband is living with me in Canada now with a visitor visa, he came at Mar 6th which means he needs leave Canada six months later which is around Sep 6th. I forgot that he needs to extend the visa 30 days before the expire date. Now it’s only about 20 days left until the expire date, can we still apply for extend? And question 2, his passport is about to expire at Oct 15th so he has to go back to China to renew the passport, since we are doing the inland sponsorship application, is he allowed to go back to China?

Did you include an OWP with the inland application?

He should really remain in Canada during the processing of an OWP application. If he leaves for extended periods of time, the application may be refused. There's also always a risk he may not be allowed back in when he returns. Can he renew his passport from within Canada? (It's a shame you didn't renew the passport before applying for PR. That would have been the best choice to avoid potential complications.)

Yes - it's fine to apply for a TRV extension with less than 30 days remaining. However I don't see the point in apply for a visitor visa extension. The OWP gives him implied status to remain in Canada. The TRV extension will not be granted beyond the validity of his passport (same as the OWP). So if he cannot renew the passport from within Canada, he needs to make plans to leave by October 15th, renew outside of Canada and then hope for a smooth return.

In this case, do I still need extend the visitor visa? Since he is only allowed to stay in Canada until sep 6th. I don’t think we will get the OWP before Sep 6th but there is a possibility we will get it before Oct 15th. Once we do the extend for the visitor visa, he will be in implied status so he is still legal in Canada. If we still not get the OWP before Oct 15 than he need go back to China and renew passport there. Is that sounds all right?

Do you have AOR?

To be honest this is more a Chinese embassy issue than Canadian immigration. I've no experience of dealing with your embassy but I would probably keep trying as it's easy for them to fix this for you.

I don't believe you'll be out of status, particularly if you've not had your application returned, but I'm not an expert so don't want to give false reassurance.

To be honest this is more a Chinese embassy issue than Canadian immigration. I've no experience of dealing with your embassy but I would probably keep trying as it's easy for them to fix this for you.

I don't believe you'll be out of status, particularly if you've not had your application returned, but I'm not an expert so don't want to give false reassurance.

Usually around 2 months after AOR, so I'd be hopeful it was done within 3 months (for passport expiry).

You're on implied status now.

I'd check Chinese embassy forums if they exist and hustle to get them to issue new passport. If you'd lost it they would have to do something. Not suggesting you lie, but someone inside must be more helpful!

Thank you so much for your help! I just have one more question, do I have to extend his visitor status now to make implied status or he is already implied status?

I was in a similar boat, my passport expired after applying for the PR and the plan was to renew it in the embassy in Ottawa but they do not renew electronic passports. So was told if we get my old passport (non-electronic) they can renew it temporarily FOR the PR process. But i also had to sign a declaration that i will not travel nor use the passport for the duration of the PR application. This helped since for the OWP and the PR process they need a valid passport/travel document.

I believe to add on, if you speak to the embassy and tell them you are applying for the PR they should be able to issue you a temporary passport or travel document to aid the process. I mean they technically should it only makes sense.
