I am canadian citizen married to indian citizen. I am currently in India and started filling the applications forms for family class sponsorship.
My questions are:

  • Are the medicals required only for the principal application or also for the rest of the family (my husband family)?
  • I would like also to know if the application kit has to be sent along with the police certificates and the medicals ? Or can it be sent later on?
  • Does the application have to be sent to the canadian embassy in India or to the immigration office in Canada?

Since I am currently in India, and no one lives in my appartment in Canada. I will be traveling for the coming 5 months and will not be able to go to Canada during this time. Where will I get the approval letter for sponsorship? Is it possible to ask for correspondance through e-mail?

The medicals are required for the principle applicant and any accompanying or non-accompanying "dependents" of the principle applicant. You cannot sponsor on a spousal application anybody else but your spouse and his/her dependent children.

You won't want to send proof of medical and police certificates before you actually send the application kit. They wouldn't know what to do with them. Send the completed application packet and include the proof of medical and the original PCCs with it.

All spousal sponsorship applications are sent to the Case Processing Centre in Mississauga, ON first, so the sponsor can be assessed as to their eligibility to sponsor. If the sponsor is approved, then CPC-M transfers the application to the overseas embassy (in your case, India). If the sponsor is not eligible, the application is dead because an sponsored applicant cannot be approved without an eligible sponsor.

Since you are currently in India, you must also include evidence with the application of you intent to return and re-settle in Canada. The fact that you have a residence in Canada is a good start - but you should have some concrete plans for where you will work and when you intend to come back. The fact that you intend to travel for the next 5 months, while the application is in process, could complicate things for you. I don't know that they will correspond by email because this residence thing is such an important component of the process. You can use a mailing address in India - and they will send notifications and such to you there - but if you do that, be sure you also have really strong support for your imminent return to Canada. You might want to consider waiting to submit the application until you're closer to a return date - and not off traveling while they're assessing your eligibility.

You could use a relative or friend's address in Canada as your mailing address. They could then contact you by email to tell you what any correspondence from the gov't says, and send it to you if necessary.
Only your husband and his children, if any, need medicals. His parents and siblings are listed on the 'additional family' form, but do not submit photos or medicals.

I asked the immigration call centre in Canada that if I go and settle down for some time (of course below 6 months) with my husband, do I have the right to sponsor? They said as long as you don t go beyond 6 months and that you still benefit from the social insurance in Quebec, it should not be a problem. It is a proof that you are a canadian resident in Canada. I am on the process of looking for jobs and my spouse is the one currently affording for the living expenses. How can explain them all this?
