Hello all, please I need your inputs on the requirements for sponsoring my nephew who is an orphan. I am presently in canada as a PR since July 2019 and started working already. I have the death certificates for both parents. I need to know if there are other requirements relating to income and length of stay in canada. Thanks.

Will you be able to adopt or take on legal guardianship?
 
I believe that if you are able to legally adopt him, the answer is yes and process somewhat straightforward. There do not appear to be formal income tests.

There may be other ways of sponsoring but this likely the easiest if adoption can be done in the country of origin.

Note that you would have to do this from Canada, ie not reside out of Canada. Shorter trips may be okay.

Also important - I'm writing this without regard to the adoption process itself, which will have its own requirements that may be equally or more daunting than the immigration aspects.

How old is he? You would need to adopt him first.

You need to start by going through the adoption process for that country.

Orphaned brother, sister, nephew, niece or grandchild
You can sponsor an orphaned brother, sister, nephew, niece or grandchild only if they meet all of these conditions:

  • they’re related to you by blood or adoption
  • both their mother and father passed away
  • they’re under 18 years of age
  • they’re single (not married or in a common-law or conjugal relationship)
