Sponsorship doubts - I bring the bacon home, but she is "sponsoring" me.

Hello friends, I know it's another "HELP ME" topic, but I have plans to participate more in the forum, as soon I have more experience and can help too! For now, here is my situation:

1- Come to Canada Sept. 2010 to study, 1 year program
2- Got married in August 2011, she is Canadian, and we have a baby girl now
3- My post-graduation work permit expires now Oct. 2012

Can she sponsor me, even if she doesnt' work? I'm the one bringing the bacon to the house, so banking statements are all on my name.
If yes, can I apply for a open work permit BEFORE I send the sponsorship application? I have a job offer, but they will not send me a letter for work permit solicitation.

What can we do? I cant go back to Brazil and wait there, I can't be away from my girls!!! Also, I already have a job here (self-employed + occasional temporary work) they need me here to keep up with the bills!

Yes she can, and I'd say, GET your PR application in NOW - ASAP. I've been told here once you have submitted an application for PR 'Family Class' you will be allowed to apply for 'open permit' while you wait. BTW, I think the reason they won't give the letter to you to is because "they" must obtain an LMO (Labour Market Opinion) before your employment with them will meet 'work permit' conditions.

To give you a bit more context on the outland vs inland speed - if you apply through Sao Paolo, you will likely have your PR visa before you would even complete step 1 inland. You can see the timing for spousal sponsorship here. If you have plenty of proof your relationship is genuine, it is HIGHLY unlikely you'll have to fly to get an interview.

You'll most likely be done outland in 11 months via Sao Paolo: it takes about 3 months for Outland step 1 in CPC-M plus 8 months for 80% of applications to be completed through Sao Paolo (the fastest 20% are completed in 4 months - see here for all the details). Inland, the initial assessment alone takes 11 months alone (and my understanding is that they won't look at WP included with the app until the end of step 1; plus the second step takes an additional ~8 months).

Plus, FWIW, outland means you keep the right to appeal should it become necessary.

By what I understand, only in a interview case we would have to fly to Sao Paulo right? Yes, you can just send the application to Sao Paolo even if you are in Canada. It says so in the inland instructions themselves - you don't have to believe me blindly :

"The family class is aimed at faster processing of spouse or common‑law partner applications from applicants outside Canada.

Processing times for spouses or common‑law partners in Canada are generally longer.

The person being sponsored can apply to a visa office outside Canada to take advantage of the family class processing standard. Processing times for applications processed in Canada are posted on our Web site."

Also - one of the advantages of outland (apart from the faster processing!) is that you can still travel in and out of the country... if you file inland, once your application is sent, then you can not leave the country. If you have to go back to Brazil (for a family reason etc) your application will be "abandoned" - while if you apply outland, you can go back and forth, as long as they let you back in the country - it's never a guarantee but at least your application will still go on.

We filled the application forms, all printed!
Now I need, medical exams, police check, relationship proofs, on their way....

I tried to pay the licenses, and got confused, people on the "how much it cost for you" thread said it was 1040,00 for the official fees, how come? (I tried to post a screenshot from the CIC website, but I can't post link yet...)

Shouldn't I select :
1X Sponsorship Application 75.00
1x Principal Applicant (My wife) 475.00
1x A family Member of principal Applicant 22yo spouse (me) 550.00
Total: 1,100.00

By the way, they make the terms confusing, on the forms, they say principal applicant for the person who is COMING TO CANADA, and filling the IMMIGRATION APP FORM. Now here on the fee payment, it looks like the principal applicant is the person SPONSORING someone to live in Canada...

I know it sounds dumb, but this little details are enough to create even more doubts!

Another question, where I can find a list of approved doctors for my medical exams?

Ok those fees are slightly wrong Sponsorship fee $75 Correct
Principal applicant $475 Correct
1x A family Member of principal Applicant 22yo spouse $550 (Incorrect you need the right of landing fee which should be $490)

Total should be $1040

Principal applicant is the person COMING to Canada
Sponsor is the person who resides in Canada or has Canadian Citizenship
