Hey!

I have one concern. So right now I'm in Canada on temporary work permit. I just got marries with canadian citizen and he wants to sponsor me. It takes 11month only for first step to get approved if I apply for pr within Canada. It takes though only 55 days if I would apply from outside of Canada.
So my question is: can I go back home (to Ukraine) and apply from there and then enter Canada back? I really don't want to wait 11 months, so I was wondering if it's possible to do this way.
I will really really appreciate your advices!!!!

You can submit an Outland application while you are [legally] in Canada. You would need to maintain your status throughout the process, but you don't necessarily have to leave Canada to submit the application.

Good luck!

Thanks a lot.
So would I be able to apply for open work permit after the first step is approved?
And if I apply from outland, will I have to travel for the interview to another country?
I'm really confused about that all

No. An OWP is not available if you file an Outland application.

Yes, if you are scheduled for an interview you would have to travel back to the Ukraine for the interview, but...if your application is strong, you may not need an interview.

Do you know what the overall processing times are for an Outland application?

With an Inland application, you would be eligible for an OWP after you have stage 1 approval (AIP), which is currently 11 months, but...the date changes all the time.

Processing time for my application from outside of Canada would be around 15 months (55 days for 1st step and 13 months for second). So it's probably a better idea to apply from inside of Canada, this way I might get my OWP faster. Can I submit an application for OWP along with my permanent residence application?

Think about it. You need to pass stage1 first in inland process,to be able to get OWP. Thats already 11 months, isnt it? And whole outland application takes max 15 months. I would advice you to contact visa office in Ukraine and ask them how long it usually takes to process this kind of application. Im from Poland and i just received PR from common law outland application (Warsaw). On the website it said it takes 8 months for stage2. In fact it took them only 3,5 months and whole process took for me 134 days (stage1+ stage2). Immigration officer from Warsaw said that they process 20% applications in 3 months, 30% in 4 months and 50% in 5 months. Also you can look for some ppl in the forum from Ukraine and check how long it took them to process outland applications, you can check spreadsheets also from all the months.
If you will decide for inland application, remember your partner must meet some requirements also, check out this link: http://www.cic.gc.ca/english/work/apply-who.asp

I highly recommend outland. I follow spreadsheets for people from Kiev / Moscow. Usually anywhere from 3-9 months as outland and, assuming you forgot nothing, no errors, and strong case, you get everything done in that time from there.

So... yea. It`s a no brainer. Go outland.

Thanks a lot for your advices!!
So if I decide to go with outland application then I'll have to send my documents directly to Kiev (Ukrainian office)?

No, you send them to Canada first so they can work on first stage (about your sponsor). After first stage is done, they will send it directly to Ukraine.

I wanted to apply as his common-law but we decided to get married instead. Only a court marriage though. Do you think it's gonna be enough: joint bank account, same address, photos?
We had small engagement celebrating but it was only both of us, nobody else.
We have no money for wedding ceremony yet:)

You will have to explain why your family didnt attend to the wedding. In the from they will ask you about it, just be honest and tell that you didnt have money yet and you and your partner wish to make better ceremony after u got enough money. This is what i wrote, we had no money for the wedding + it would be hard to gather families from both countries in one place, since plane tickets cost a lot etc etc.
About the photos - i advice you to attach lots of those where u guys are among other people: friends + families. Your relationship must be recognized by others and this is the key (in my opinion).
Try to prove that you guys were going for some trips together, even small ones, i added some photos from trips, also attached receipts and tickets.
Some postcards would be also good, chats from facebook or skype, emails etc. Get at least 2 letters from someone of your friends or family and those letters must be signed by lawyer.
I felt quite confident with my proofs so try to follow :D

What kind of letters should it be? What do you mean?

2 reference letters from someone of friends or family that will describe your whole relationship and prove genuineness of your relationship. They need to be notarized. Letters must describe relationship between you and that person, how u know eachother etc and then when and how that person met your partner first time (dates), how that person spent time with two of you, describe all positive aspects of your relationship. Letters should be quite detailed, dates and places are important, its good to mention other people also. Here u got the link with sample letters http://www.canadavisa.com/canada-immigration-discussion-board/relationship-support-letters-examples-t47010.0.html

You will need to attach everything thats written in the guide for outland application for western europe http://www.cic.gc.ca/english/pdf/kits/guides/3902e.pdf . Go step by step and dont miss any part.
