Sponsorship and Open Work Permit Application (IMM4509E question!)

I asked this question before in the temporary worker forum, which the wrong place to ask, sorry!

I am currently filling in and collecting all the forms needed to start the Sponsorship Application. I am staying in Canada right now on a Visitor's Visa and plan on attaching an Open Work Permit application with my Sponsorship Application. According to CIC this would allow me to be in an Implied Status even after my Visitor's Visa expires, making sure I won't get deported or anything. Plus I would be able to get back to work.

To get to the point, my Sponsor is my Common-law partner who is a Canadian Citizen and lives in Toronto. In the Open Work Permit application package there is a form called IMM5409E, known as the Statutory Declaration of Common-law Union. according to the introduction page it says this is only needed to be filled in if my Common-law partner is accompanying me to Canada..

Now since she is already a Canadian citizen and I have already filled in much information about my Common-Law in the actual Sponsorship Application, do I have to fill in this form as well? It's asking me if I have life insurance with her as the beneficiary, but I am not even a Canadian citizen yet!

No. You do not need to add it for the work permit app. It doesn't hurt to add it to the overall application though since it seems you are choosing common-law sponsorship. I have seen some cases where it's not sent initially and it's requested after... or sometimes not at all.

Ok, thanks so much! One last question, I'm looking at the Checklist for the actual Sponsorship Application, and it's asking me for 'An original Option C Printout of your last Notice of Assessment for the most recent taxation year along with printouts of all income slips (e.g T4, T4E...)'

So the thing is, my sponsor has her original income slips and the T4 letter that she received last month from her work that she is going to need to file taxes with. Are those slips and T4 letter what CIC needs? Are those the Original Printouts? She can always get copies of those printouts later to file taxes with, I just really want to send out this application. Thanks!

No. The Option is something she has to request from Canada Revenue. So after she files taxes she asks for it. If she asks for one now, she will get the 2009 tax year since she didn't file 2010 tax year yet.

Ohh ok. She actually has a Option C printout of 2009 already, but that year she wasn't making any money.. however, as far as I know, she doesn't need an income to sponsor me, right? Plus I can send in some papers proving she has been working and been making plenty of money to sponsor me since then.. Plus a letter of employment.

Is the 2009 Printout good, since this year's taxation year hasn't been completed yet (she hasn't filed taxes for last year yet) or does it HAVE to be the 2010 printout? If so, that would mean I would have to wait to send in the application until she files taxes, waits for it to be done, etc..

Because then, I could send them the Option C of 2009, the T4's of 2009, and the T4's/Income slips of 2010 just to show she currently has an income. Would that work, or is a 2010 Option C required?

Are you applying inland or outland? When I filed in May, my hubby still had not done his taxes so we sent 2008 tax year Option C. We just attached a note that we will send 2009 one later. I sent it in Nov. I don't know if made a difference. Our sponsorship got approved. It took 9.5 months to assess the sponsor though since it's inland. Now if it's outland they take like 5 weeks or so to assess your sponsor so not sure. Maybe you could try with the note and if they still need 2010 they will request it.

:) That's a great idea, thanks! I'm doing the inland one.. that's why I'm also applying for an open work permit, that way, once I get approved in principle, they will give me it and I can get back to work sooner! I'll send them the 2009 one, add a note saying I'll send the 2010 one if they need it, and add the T4 of 2009 and 2010 to show that she's been doing good financially.
