Sponsoring Spouse

Hi,

I am sponsoring my spouse from El Salvador. I was have a few questions about the application process:

1) Would we have to include his son who is 19 and in a common-law relationship as one of his dependent children?
2) Would he need to redo a police check and medical exam if he had them done a year ago for his temporary work visa?
3) How would you apply for an open work permit as we are applying from inside Canada?

More questions:

1) How many pictures do you need to provide for evidence? Would it be a good idea to provide pictures of my husband spending time with my family and what not? And should I include on the pictures who it is in each picture?
2) What if my husband can't exactly remember all the places he has lived in the last 10 yrs? Also he was conscripted into the army (he is from El Salvador) he was never in active combat or anything but he cannot remember his rank, unit number or commanding officers? What should we do there?
3) Just out of curiosity... are spousal applications approved for the most part?

Alot of what you ask can be found on the CIC website in the guides there. But I'll do my best.

For your first questions:

1. his son is not considered a dependant child if he has a common-law partner

2. Yes, your husband will have to re-do the police clearance & medical. At the time you submit the application to CIC the police clearance cannot be any older than 3 months and the medical is valid for one year and must be done by a DMP specified in the immigrant's guide.

For your second questions:
1. As many as you think necessary to prove your relationship. And yes include pics of your husband with your family and vice versa - this helps prove your family ties. It is best to indicate who is in each picture and where and when it was taken.

2. Your husband will have to do his best to provide the most information possible. Whatever the circumstances, don't lie or make anything up. Be honest and, if he can't remember certain details, have him write a note explaining so to CIC.

3. Sponsorship approvals depend on a number of criteria. While several are accepted, just as many are refused . It will be up to you and your husband to ensure completeness of application(s), have your police clearances & medicals done by a DMP, prove the sincerety of your relationship, include supporting documents and proof, etc. It is a long process that requires a strong heart and tons of patience!

Yes I have looked at the guides pertaining to our situation on the CIC website but they are not very straightforward. Actually they are rather confusing and I do not want to miss anything or do anything incorrectly. If we are doing the application inland, how would you get a police check from El Salvador? Also would all birth certificates etc. need to be translated? They are all in Spanish...

If you are translating in El Salvador its best to contact the embassy and ask who they recommend for translation. If it is done in Canada there are many translation services. I guess check the yellow pages
If your husband can get a travel visa to Canada the inland process can take a much longer time then doing it through El Salvador.

(4) Not all cases receive “first stage of approval” at CPC Vegreville. Some files may be transferred to a local CIC office. This may add further delays to the overall processing time.
Which can be around 1-2 years waiting.

Our visa section in El Salvador is run by the Canadian Embassy in Guatemala. However, we have locally engaged staff who is responsible for receiving and processing non-immigrant applications, collecting the appropriate fees and answering general inquiries. The Canadian Embassy in Guatemala handles the final process of the applications and all the issues related to Permanent Residency in Canada. The waiting time for Guetemala is equally as long as it would be in Canada, thats why are not having it processed there because at least with in Canada, he can get an open work permit after first stage approval.
That sucks that it has to be a certified translator, when we got his divorce certificate translated that was over $100, so its going to cost us about $600 to get all of his documents translated...
They check the genuiness when it is sent to the appropriate Canadian visa office. If it is an inland application, the person being sponsored fills out a spousal questionnaire. The approval of sponsor is only to determine whether your application is complete and whether you are elegible to be a sponsor or not, they don't even review anything about your spouse or anything

Could you please advise - whether it is really possible to get a work permit once the 1st stage of the approval period is done? what the sponsored person should do have a chance to get that permit? Will the sponsored application be a hindrance for it?

Check with some other certified translators. I'm from Peru and we translated about 4 documents for $40. Prices should be similar.
