Hi everyone,

I would really appreciate your help regarding sponsoring my spouse .

I have a PR ( landed last year). I have got a job in Canada where I will start on Nov 1. When I applied for PR I was single. I have got married recently and I'm planing to sponsor my wife.

My questions are:

1- Do I have to notify CIC that I got married even If I haven't start the sponsorship process? if yes how?

2-Is it possible to have my wife to apply for temporary resident visa (Visit visa) and stay with me in Canada. Or is it better apply for a student visa?

3- What I know is that applying outland is faster than inland? Is it okay to apply outland while my wife is in canada on visit/student visa?

Thank you in advance

Khalid

1. No. As long as you were married after your landing, they don't need to know your situation has changed until you are ready to file the sponsorship application.

2. She can apply for either, but needs to show strong ties to her homeland and why she would return there even with a Canadian spouse.

3. It depends on what visa office would process your wife's application. Yes, you can apply Outland while she is in Canada if she comes to visit or study, however if her visa office is one of those that requests her passport as part of processing before they are ready to issue a visa, she might have to return home to submit the passport and wait there until she has her passport back to return to Canada.

Thanks a lot Charlie for your quick reply.

The wedding will be in a month from now. We are planing to go together to Canada. I have heard that if she now applies for TRV (visit visa) it would be easier if she didn't mention that she has married to someone who is residing in Canada.

And while she's in Canada, would it be okay if for her to enter Canada every time (I assume she'll get a multiple entry visa)

Do you think it would be okay if she applies TRV without mentioning that she's married until I start filing the application for sponsorship.

Thanks!

If she is married when she applies for the TRV - she must say she's married. If she says she's single when she's actually married - this is misrepresentation. Misrepresentation is typically punished with a two year ban from Canada.

Not sure your 2011 world income and income of the last 12 months are but if you file sponsorship application this year, you have to prove you are financially sound (enough income). She can apply for TRV now as single but not after the wedding.

Would it be better for her to apply for student visa? I'm afraid that they might reject the application for student visa because I hold PR status

Most of universities start new school year first week of September. Not sure you have enough time to get Letter of Acceptance and apply for her student visa. If your visa office process outland sponsorship application less than a year, you should stick with it and proceed as it is. If more than a year, well, you have to decide. Remember, depend on her circumstance and country, chance of getting a TRV is slim. With spouse in Canada, it's even harder for her to get one.
