Hi all,

I am sponsoring my wife, who is in U.S. I am also currently working/living in U.S. I have filled out the application for sponsoring her.

In sponsor questionaire, there's the following question:

1. Are you currently living in Canada?
Yes:
No: When do you plan to return back to canada (--/--/----)
Provide proof of your intention to re-establish in Canada. Attach photocopies of one or more of the following document(s) as applicable.

- Job offer in Canada
- Employment contract in canada
- Letter of acceptance by an educational institution in canada
- property rental agreement
- properly deed (Can some tell me what does this mean?)
- mortgage on property
- other (Explain.....) What else can be acceptable proof of returning to canada.

Can some one please comment on this.

PS: I am a canadian citizen, working under a contract (NT visa) in U.S. and my job contract ends at the end of november, so what can/should I provide as proof of re-establishment to canada, for this question? Please help.

Thanks,

Toledo.

We are in the same situation. My wife sent a letter explaining in detail how she plan to return to Canada, including letters from family members willing to offer housing for the first few months if needed. She also had a letter from an employer offering her a job upon her return to Canada (no starting date – just when ever she returned). Her sponsorship application was approved.

At first we tried to explain her US visa will expire and she would have to return to Canada no matter what – but that didn’t fly, it wasn’t enough to prove her intention to return.

Thanks for reply,

So, what would you recommend I should do/prepare in my situation. I am still under contract and even if I look for a job now, no employer is gonna promiss me to hire me upon my return to canada, say 6 or 7 months from now. Can you advise, as what else can I do?

I would recommend you to write a letter explaining your background, and detailed plans what you have done and will be doing to find a job and relocate to Canada. Attach a copy of your NT and explain to Immigration it will expire. Do you have friends/family that can write a letter offering housing for a few weeks/months until you have a job? We did all of this. We also included bank statements/investments showing Immigration we have the funds to live (without income) for a period of time. If I remember correctly I believe I wife even wrote a letter explaining her personal reason for wanting to return to Canada rather than live in the US. Right or wrong – I don’t know, but she got approved as a sponsor and that is all we care about…

Hi GK,

just wondering, when you say "it didn't fly", did you mean that the sponsor application was rejected or did they request more information from you?

I think it's hard to show the proof that they ask for when you don't know when your application will be approved and when you can move back to canada. it's great that your wife got a job offer before returning, I think it isn't really easy in gerenal to achieve this.

we will try to include a statement to explain what we've done so far for jobs, who we would stay with when we arrive (my aunts), how we'd rent first and buy after in which area, how much we currently make, and bank statements.... I wonder if this is enough. fingers crossed!!!!!

thanks

Sorry, I wasn't clear. No, her application was neven rejected. However, before we sent the application we contacted Immigration (yes, we managed to get them on the phone... They advised not to use US visa argument as the only proof of intention to return. The risk of application to be rejected/returned was high.
