Kindly help us decide how to proceed:

1. Since my son only has PR visa and his wife does not hold any Canadian visa ( not even visitor visa ),his wife can not accompany him to Canada. Is there a way for him to take his wife to Canada so that he can reside in Canada and sponsor his wife's PR as he has to be in Canada to sponsor ?

2. What other ways / visas are there for my son's wife to go to Canada along with him ? She can not stay alone in USA while her sponsorship is being considered as she is on dependent visa in US. It looks like it will take 12 months for thee sponsorship application to be processed.

3. What is TRV and can my son's wife apply for one and what grounds will help her get her visa approved ?

4. Can she independently apply for PR after taking IELTS etc., ? Is this legal ? Will she has to mention about her husband's PR status in her application ?

5. What other paths are there for her to go to Canada while her sponsorship is under consideration ?

No one can tell you how to proceed. This is a decision your son needs to make along with his wife.

1. She needs to get a visa to be allowed to enter Canada temporarily. She cannot enter Canada without a visa. The options are to get a TRV / tourist visa, a work permit (this requires her to get a job offer from an employer in Canada and for that employer to get an approved LMIA), or a study permit (this is an expensive option since she would need to pay international student fees and she will need to make sure her planned studies in Canada make sense in light of her previous education and work experience).

2. See above. If she cannot remain in the US and cannot find a way to get to Canada, then she can return to India and wait out the processing of the spousal sponsorship application there.

3. TRV is a tourist visa. She needs to qualify on her own and will need to prove her stay in Canada is only temporary. Probably a 50% chance of approval.

4. Yes, she can do that. She won't be able to claim any points for her husband's work experience or education or anything else. She will need to qualify and be selected all on her own. Note that there have been no FSW / EE draws so far this year and she will need a score of 470+ to have a chance of being selected once draws start again. Also keep in mind that the processing for these applications is over a year right now.

Your son needs to be prepared that there is a good chance that he may be separated for around a year from his spouse. If she is able to get a TRV she may not qualify for free healthcare until she has PR or gets a WP and is working full-time in Canada depending on the province. Many cases where women especialky arrive and realize they will have to pay for things like maternity care out of pocket.

Assume none of you have landed, it might be quicker (for everyone to land in Canada together) if your son's wife is added to your existing immigration application.

Yes. But he has landed and obtained his PR card and returned to US as he is on H1b visa in US.
