Situation
I am already in Canada i have a job and i am planning to sponsor my spouse for PR.
We have been married for over 5 years now
My spouse is not in Canada

Assumption
Fast forward in future and assume his PR is approved

Primary Question
Will my spouse get an independent PR
Will it be valid for 5 years from date of soft landing with 2 year minimum stay during 5 years to qualify for extension/renewal

Secondary Questions
Will it make sense to apply for work permit for my spouse while we wait for PR to be approved ?
Is the process of work permit faster compared to getting a PR

Appreciate any help

You can be living / working in the U.S. and be financially responsible for her from there.

In order for your spouse to qualify for a work permit, they must be in Canada on a TRV - AND you must also submit an inland application for spousal sponsorship (whichyou can only do once they have arrived in Canada).

Would add that you must be living together in Canada to qualify for inland PR since you mention working in the US. A short absence of 2-3 weeks seems to be overlooked.

Thank you all for your response. It's a long story, but the crux is, i have not been able to spend time in Canada as much as i wanted and did not start with sponsorship for my spouse

New question
Beginning Jan 2021, i plan to spend 2 - 3 weeks in Canada every month, and be back in the states for a week or 2 depending on work and family situation. If i sponsor my spouse will there be any issues given i am also spending time in US ?

If the quaratine is still in place (which is likely in Jan 2021), are you planning to stay 2 weeks in quaratine and then leave every month?!
Also every time you cross the border, there is a chance they look at your RO. Are you close to meeting RO ?

Yes for quarantine, I’ll buy supplies for my stay before I enter. If required I can get recent records, MA does free testing.

my target is to spend 3 week worse case 2

The primary hold back is my spouse pr, once we have it we can move.

My main concern is will my travel between us Canada every month affect spouse sponsorship. do I have to be physically present in Canada throughou?

As a PR you must be living in Canada to sponsor your spouse so yes spending that much time out of Canada will be an issue. You also must be compliant with your RO to sponsor.

Either way it is what it is, if the sponsorship goes through we will move, if not we stick to US.

2/3 of the time is not enough. When did you land and how much time have you spent in Canada?

March 2019 is landing

I know it’s not enough if I do it throughout remaining term. The plan is to spend 2/3 for next year until my spouse gets pr. After that it will be l95% or more in Canada.

Its simple, I don’t want my spouse to quit job loose income and experience from us. That is the reason for travel between countries.
