Might be worth having your MP contact CIC on your behalf.

If you/they can prove that it was CIC's mistake, they should fix their mistake by allowing your application to be included this year.

As unfortunately that it is CIC's mistake all along, CIC is still not going to allow the application to be added back to the cap and make it 5001 limit. The resent application will not even be opened and looked at. It would simply be left unopened and returned with note that cap has been reached.

Hence my suggestion to contact the MP.

At this point, the applicant has nothing to lose.

I will share the info based on my understanding, forgive me for any unintentional mistake. Everyone should complete IMM 0008. There is second IMM008 which you only need to complete if you have more than 5 dependents. But first one is required of all. So lets say even if you are only sponsoring your mom, and no other dependents, the purpose of the form is for them to capture whether or not dependents exist for future sponsorships. The form ask for spouse info. or dependent children info. So lets say even if someone's spouse passed away or they are now divorce and not accompanying, this form still needs to be compeleted for them to capture that info. This is my understanding and I hope it helps. Wants to share a bit more info with people who are waiting. I called CIC again today although my CC has been charged to get info to help others.
I asked her the status of my app without telling call agent that my cc is charged. She said all i can say is that we have received your app. If it made it in the cap or not, we cant provide that info as it will be communicated in mail. She said one hint for you would be to see if your CC is charged but even if its not charged dont panic because they are still working on applications and they are really busy. Per her, there are lot of changes immigration is going through and since lot of things are also new for them, it is taking them time but they are working to fast track things.
So my fellows on forum, keep hope, and keep praying for each other.

I am sponsoring just my mother. No additional dependents. We are 3 people in Canada : myself, my husband and my 12 years old son.

I wrote on the document check list that its not applicable. That's why my application came back.

Please help me what should i do for next time and where is my mistake.

I think if you just missed this 0008DEP form than you are correct and have every right to be reconsidered...now you can certainly resend the same package with the covering letter but the KEY here is that did you find any Note number or File number or Received number or Received time stamp on the package received back.
If yes and if they find that it was their mistake, they should reconsider you.

Is your father still alive and married to your mother? Did you include your father info in the IMM008 form as your mother's defendant?
I'm sponsoring my mother only and I included my father info in the IMM008 form, regardless of him accompanying my mother to Canada or not.

I agree with you on everything except that "if the spouse passed away or divorced, even then 0008DEP needs to be completed". Where do you got that info from?
Dependent means alive and legally dependent

Actually, it IS a good idea to write N/A on the document checklist for forms that are not being included, so that the person reviewing the application KNOWS that the form wasn't overlooked.

I have a similar scenario. Mom and dad are separated and haven't spoken in a long time. Got an affidavit done stating this and that we are not dependent on him and no longer communicate. We mentioned that h was a former spouse, and under dependents put in Not Applicable.


On the document checklist, I checked that I've included the form. When filling out IMM0008DEP, I typed in "Not Applicable" in 2 fields to ensure that they saw that I had indeed looked at the form and understood what it meant. Got the principal applicant (My mother) to sign it, and include it as part of the application.

That's what I did anyway.

Hard to get these right, since it's a bit grey.
