Hello,

I'm came to Canada as a student and then over time became a permanent resident. All seems to be going smoothly apart from the fact that I'm unable to secure a PR for my mother (who is the only person in my family). I had some questions on that regard:

1. Can I sponsor my mother with the PGP program? Since it has been three years for me (of which two were as a student, though I had a decent income during these years as well), someone said I needed three years of income to be above the minimum threshold for me to sponsor - is this still the case under the lottery system?

2. Can I sponsor her Super Visa instead? I believe only a year's income is required for it?

3. Can I sponsor her under a humanitarian scheme? Since I'm the only child. Country of birth is India and we don't really have a crisis there.

Also, she has a 10 visitor for both US and Canada, would it be a problem if spends some days in Canada and then some days in US - each time ensuring the 6 month deadline isn't crossed? Or would she need to return to her home country? If yes, for how long?

1. Yes - you need three years of income even under the lottery system. You'd have to have made around $40K each year for the last three years to qualify.
2. If you meet the super visa income requirements - yes.
3. H&C has a very high refusal rate, takes a long time to process and requires her to be in Canada. If she's refused, it will be difficult for her to return as a visitor in the future.

1. Does it need to be an average of $40k? or does it be $40k every year at least? - where can I read more about this?

2. She's in Canada since about a year (leaves before 6 months period is up), would that be a hinderance in the Super Visa process?

3. So you think it isn't a gamble worth taking?

To add, for supervisa you don't even need 1 full year of income. Just a letter from employer stating your job info and salary would suffice to meet income requirement.

For H&C, you being a single child is NOT a H&C reason to sponsor your mother outside the PGP program. H&C is reserved for those people in Canada who would face some kind of risk to their life or extreme hardship should they return to their home country. Simply wanting to move to Canada to live with a child, does not in itself meet this criteria. If you decided you proceed with a H&C application you would need to put together a convincing case as to why it's warranted.

From what I've been gathering so far,

For a Supervisa - one needs to be in their home country / outside Canada. In Canada, you only get extensions.

For H&C Grounds - my mother would be the only person living in India, no relatives (everyone is in US or me in Canada) - wondering if that would make a case strong enough for H&C - extreme hardship!

H&C is risky. Even if your mother is alone in India, that certainly won't guarantee approval (approval rates for H&C applications are low). Once H&C is refused, it will then become next to impossible to obtain approval for either a visitor visa or super visa. So you can certainly try the H&C route - just be aware of the consequences if the application is refused.

Does she have some medical condition that requires someone to care for her? Or is in some other way unable to live on her own in India?
