Hello, I have a couple questions. My husband and I were just married, he came to visit me in Canada for this occasion, and he has already prepared all of his documents and has had them notarized. This being said there is an expiration date on them for the end of August. We are applying for spousal sponsorship outside Canada as this fits our situation more. My question is because I have to wait for my marriage certificate to come in the mail before I can change my last name, and that also takes at least a month, do I just put my family last name on the documents and then when my name change has been finalized notify the government? or should I just not change it until he can receive his PR card? The problem I don't want is his documents expiring. I was also planning on meeting him in Korea and staying with him until he receives his card. Has anyone had trouble proving that they will return back to Canada? He will be graduated school and working in Korea and when we come back to Canada I will also continue my schooling.

If it's at all possible to wait until after he gets his PR, I wouldn't change your name until then. My experience with the VO in Manila is that they are easily confused by Korean applications. A name change midstream may well delay your application. Get his application in before your docs expire and change your name after the application has been processed.

I think this has been an issue recently for a few Korean applicants, even those who have left Korea and are living and working back in Canada. There's not much you can do to avoid the issue if the Manila VO decides they want you to prove you're planning on returning to Canada. Just for further clarification since we are applying outside canada I still send all of our documents to Mississauga and then they will be sent to Seoul, Korea and then forwarded to the Philippines VAC office? I am only asking because that is what it sounds like when reading from here: vfsglobal.ca/Canada/korea/english/index.html

Yes you send entire PR package (sponsor part, applicant part and proofs/evidence) to Mississauga first.

They will forward directly to Manila. There is no Seoul office anymore for PR processing.

Almost correct. You send it to Mississauga where they process your sponsorship application. That usually takes about a month. Assuming the sponsor's application is approved, the file then goes directly to Manila where they process your husband's application. That's a much longer wait.

The Seoul visa office closed in January 2013. They no longer process PR applications there.

Great thank you! Just another question. When filling out his name on the sponsorship documents his name is all in capital letters (first and last name) should I follow this on the documents because it does state to write it exactly how it appears on the passport or does that not matter so much?
Also, on the IMM5481E document when it asks about your parents am I to give my mothers maiden name?

I'm not sure what you mean. If you're wondering if you should use all caps or caps/lower case I don't think that really matters. The important part is the spelling. It should be exactly as it appears on his passport.


Also, on the IMM5481E document when it asks about your parents am I to give my mothers maiden name?
Sorry, where on IMM5481E do you need to mention your parents?

4. Provide the following details of your father and mother.

It asks for the family name, given names, etc.
I am assuming because it did not ask for maiden name they are asking for married name, but I just want to be sure.

And back to my question about living with him in Korea while the visa is being processed. Because I would not be in Korea at the time I submit my application I will fill it out stating that I will live in Canada. Since I am planning to stay with him in Korea from September will I have to then update my application? Or just follow the guidelines for entry in to Korea (6months no visa needed) ?

I used married name and it was approved.

Sure, you will want to update your address when you move and you can explain that you are planning on returning to Canada later. They may ask you for proof of your intent to return to Canada once PR is granted.

I have been reading a lot on the thread about the man sponsoring his Korean wife. For the proof of the sponsor and sponsored persons intent of coming back to Canada once having the PR Card it seems very in depth. Since I will be taking classes online through my Canadian university I wont really have a letter that states I will be attending school unless I register again for courses on campus but how can I do this when I do not know the date of my return. They also expect plane tickets and items like that but again because we don't know the date that his pr card will be approved how do I go about proving our intent of coming back? And should I wait to move to Korea until after I have become approved as a sponsor and then inform them of my change of address?

I think the best you can do is to explain all of that to them in your application. Just tell them that until his PR is approved you can't really fulfill your plan to return and hope that they accept it.

I don't think it really matters.

You should really consider asking these questions over in the Korea thread. There are a lot more people there who are going through the process and might be able to assist.
