sponsoring my kids

Appreciate if someone would really help me as i am very worried about me and my family future.

I am a Canadian since end 2005 I have a wife whom i did not declare while i made my landing in 2000. i have submitted a sponsorship twice but got refused twice (first time visa officer refusal was because he did not believe our marriage is genuine ; second time CIC refused because i did not declare here as i have married here two months before i made my landing ; at the time our plan was simply as i get the Canadian citizen i would apply for here to come to Canada.

based on the above appreciate to have answers on the below questions are
1- how can i know if CIC have made any report against me as now i understand that what i did was a misrepresentation in Canadian law and if yes what would be the consequence.

Note: for both cases i had received the refusal letters with no indication that they have made any report against me.

2- if No report was made against me, is it safe for me to sponsor my kids ? knowing that they were born in Y 2004 & Y 2005 before i got my citizenship late Y2005 and how can i do it with out their mother being sponsored.

Most likely they just refused the application, and didn't make any moves to revoke your PR. If they had, you would have received notification about it.

You should be able to sponsor your kids with no problem, as they were born after you landed as PR.

However you will still not be able to sponsor your wife ever. Hopefully she is looking at other ways to immigrate outside family class.

Thanks for insight

As i have two kids ,appreciate your advice if i have to send two applications separately and dose my wife "the mother of the two kids" needs to write anything.

My suggestion is discuss with the lawyer they will provide you the best course of action. How the relevant legal statue can be interpreted in your favour is the key here. I wish you best of luck!!

Yes you would need to file two applications. One for each child. In order for you to sponsor them your wife would have to allow them to be removed from whatever country they currently reside in. I don't know if they will give you a hard time about sponsoring the children since you will essentially be asking to remove them from their Mother.

Yes, you can sponsor your kids,
but your wife never would be sponsored under family class...

She will need to sign papers allowing you to take the kids out of
the country that they are living now...
that will come later, and the Visa Office will make sure that your wife
sign the papers....
I sponsored my daughters before and my ex-wife was willing to sign the papers
for the sake of the girls... better future in Canada.
But I don't know if you want to take away the mother from your kids....
that is something that you and your spouse need to talk about...
Kids need more of a mother than the father for a healthy development...
You need to evaluate if you are going to give them the quality of life and care that they need..
and if they are going to be able to take a new life without her mother...
You need to think well about all...
and if this is not the right time, there is always tomorrow...

By the way.. a father can be a good mother also... :D
But are your kids going to be able to be without her mother??

i also would like to know if applying to sponsor my kids would CIC will look again for me as i did not declare my wife while landing and would consider my original file as a misrepresentation and hence take action against me if any.

lastly what is the consequence on me as a Canadian if the CIC decided to take action on me as i did not declare my wife while landing

I don't think any of us can say for sure. I think it's unlikely that CIC will look at you again - but I supposed anything is possible.

If CIC does decide to look into you for some reason, then the worst case scenario would be that your PR status could be revoked for misrepresentation.

If CIC does (unlikely event) look into OP and pull his PR status due to misrepresentation, does that also entails that he loses his Canadian citizenship as well? You can't get to be naturalized Canadian without PR first. If PR status get revoke even though he isn't PR anymore, does it mean he loses Canadian citizenship by default?

The answer to this Screech would be "yes". I've been combing all the online publications of CIC and if he obtained his PR status and withheld info and then went on to get his citizenship, they have the right to go and revoke is citizenship. Here is one reference to it:

"Grounds for revoking citizenship
Section 10 of the Citizenship Act says that citizenship may be revoked if a person obtains citizenship through:

false representation;
fraud; or
knowingly concealing material circumstances.

The Citizenship Act also states that if a person acquired permanent resident status through false representation, and subsequently Canadian citizenship, then he or she obtained citizenship unlawfully."

The one 'upside' for him if he is looked at again and his citizenship essentially revoked, he can apply for PR once again, only this time he can 'remember' to include his family. ;)

If in the event that his citizenship got revoked, he would probably be banned from entering Canada for 5 years at least. Once he does qualify to apply again, his application for PR would not likely go through even if he included his wife the second time around.

based on all above facts would it be safe to apply for my kids or just leave things as is .

Note: at the time of landing i did not know that i have to to declare my wife (we just have married two months before landing), if i know that i would have declared my wife then and saved my self all this issues.
